B. F. Troutman to Elizabeth Simmons - Shepherdsville Lots 7-8

On 5 May 1856, Abraham Field's heirs divided his property and A. J. Field received the Shepherdsville town lots numbered 7 and 8. A. J. sold the ground to Lorenzo Hoglan, executing to him a deed bond on 16 May 1854, prior to officially receiving the land himself. Later, in court actions, the land was sold at auction by Sheriff Wesley Phelps and purchased by Samuel A. McKay on 17 Nov 1862. However no deed was issued to McKay.

Then on 14 Jun 1867, all these parties jointly approved the sale of the lots to B. F. Troutman. In February 1871, Troutman sold these two lots to Elizabeth and S. M. Simmons, as shown below.

This indenture made and entered into this 27th day of February 1871 by and between B. F. Troutman, and Missouri Troutman, his wife, of the first part and Elizabeth Simmons and S. M. Simmons of the second part, all of the county of Bullitt and state of Kentucky.

Witnesseth that for and in the following consideration, to-wit, $300 in hand paid, receipt hereby acknowledged, $200 payable six months from this date for which a note is executed, and the balance $300 payable in 12 months for which also a note is executed of same date, making in all the consideration sum $800, we hereby grant, bargain, sell, and by these presents convey unto the parties of the second part, their heirs and assigns, forever with general warranty the following lots of ground in the town of Shepherdsville, the same conveyed by A. J. Field and wife to L. Hogland, known as the clover lot, and opposite the jail between the Methodist Church and the Shepherdsville Hotel, being Nos. 7 & 8 on the new plan of Shepherdsville, lots with stable, crib and ice house thereto belonging.

The same lot of ground conveyed to B. F. Troutman and wife by A. J. Field and wife, L. Hogland and wife and S. A. McKay and wife, and the same recorded in Deed Book __, Folio __.

The parties of the first part retain a lien on the lot until the purchase money of the two notes of date 27 February 1871, payable and six and 12 months, are paid; when the parties of the second part are to with the light together with all and singular the appurtenances thereunto belonging or in any wise appertaining.

To have and to hold the said premises above bargained and described with the appurtenances unto to the party of the second part, their heirs and assigns forever, and the said B. F. Troutman and Missouri his wife, party of the first part, warrant with covenant of general warranty the premises above granted and conveyed. In testimony, whereof the said party of the first part hereto set their hands and seals the day and year first above written.
