In 1835, the following complicated deed from the heirs of Samuel Beall to Norborne B. Beall was signed. It was not however recorded in the clerk's office in 1846. In it, a 2000 acre tract patented in the name of Samuel Beall became the property of Norborne B. Beall, one of Samuel's heirs.
Then on 31 Mar 1838, Norborne B. Beall sold 244 acres along the north side of Salt River to the heirs of Joseph Nichols. This land ran from the mouth of Cedar Point Branch upstream toward Pitts Point, and was part of the 2000 acres patented to Samuel Beall.
Bullitt County Deed Book L, Pages 13-14
Whereas Robert Morris, Samuel Beall, John May and David Meade many years ago agreed to take up 100,000 acres of land in partnership, and in doing so many of the said tracts were located and patented in the name of some one of those individuals; and Samuel Beall purchased from the said John May his interest in the said lands, and then the said Samuel sold his original share, and also that which he had purchased from John May to George Nicholas; and whereas a division of a part of the said 100,000 acres was made on the sixth day of August in the year 1789 between the said Robert Morris, David Meade and George Nicholas according to a valuation made by John May of the lands so divided; and a tract of 2,000 acres situated on the north side of Salt River which had been granted to Samuel Beall upon Treasury Warrants No. 1221, 1222 was drawn by the said David Meade; and whereas Norborne B. Beall, one of the devisees of the said Samuel Beall purchased the said 2,000 acres of land from the said David Meade, but the legal title to the same still remains in the heirs and devisees of the said Samuel Beall.
Now therefore this indenture made and entered into this 23rd day of April in the year 1835 between Samuel Gwathney and Levi Tyler, executors and devisees in trust of Matilda A. Maupin, sole surviving heir of Harriet, one of the daughters and devisees of the said Samuel Beall, and Norborne A. Galt and Elizabeth his wife, the said Norborne being the sold heir of Matilda, another of the devisees of said Samuel Who together with Norborne B. Beall were the sole heirs and devisees of the real estate of the said Samuel Beall of the one part, and Norborne B. Beall of the other part.
Witnesseth that for and in consideration of the premises and the further consideration of one dollar in hand paid by the said Norborne B. Beall to the said Samuel Gwathney and Levi Tyler, executors and devisees in trust of the said Matilda A. Maupin, and Norborne A. Galt, they the said Samuel Gwathney and Levi Tyler, executors &c as aforesaid and Norborne A. Galt and Elizabeth his wife have granted, bargained, sold and conveyed, and by these presents do grant, bargain, sell and convey to the said Norborne B. Beall all the right, title, claim and interest which they or either of them may have in and to 2,000 acres of land situate, lying and being in the county of Bullitt in the state of Kentucky on the north side of Salt River, it being the same which was granted to Samuel Beall under two Treasury Warrants No. 1221, 1222, and was drawn as stated in the recital to this deed by David Meade in a division of land between the said Meade, Robert Morris and George Nicholas, and afterwards purchased by the said Norborne B. Beall from the said Meade; to have and to hold the said 2,000 acres of land to him the said Norborne B. Beall and his heirs and assigns forever free from the claim or demand of them the said Samuel Gwathney and Levi Tyler, executor &c of Matilda A. Maupin and Norborne A. Galt or either of them. And it is understood and agreed that as the said Matilda A. Maupin and Norborne A. Galt had nothing but the naked legal title of one-fourth to each in the said tract of land, and have received no valuable consideration therefore, that the said Levi Tyler and Samuel Gwathney, executors &c as aforesaid, are not nor is the estate of their testatrix Matilda to be in any manner liable for any defect whatever of title in the said land; nor is the said Norborne A. Galt to be in any manner liable for any defect of title to the same. In testimony whereof the said parties have hereunto signed their names and affixed their seals this 23rd day of April 1835.
