On 20 Aug 1796, John and Mary Whitaker sold a tract of 210 acres to Giles Davis, as shown below. This land, part of a 360 acre survey, lay on the waters of Cedar Creek, a branch of Salt River, which was patented by Whitaker on 20 Jan 1786, based upon a survey completed by Isaac Cox on 18 Aug 1788. The drawing below shows the initial survey as it was divided between the two men.

This indenture made the 20th of August 1796 between John Whitaker and his wife Mary Whitaker of Shelby County and state of Kentucky of the one part and Giles Davis of the county of Nelson and State aforesaid of the other part witnesseth that the said John Whitaker and his wife Mary for and in consideration of the sum of 68 pounds to them in hand paid the receipt whereof they do acknowledge and confess have given, granted, bargained and sold unto the aforesaid Giles Davis his heirs forever 210 acres of land situate lying and being in Nelson County on the east side of an entry made by Robert Fersithe lying on the south side of Salt River about three miles from the mouth of Cedar Creek, binding and running as followeth. Beginning at [A] a poplar, white oak, beech, running thence East 220 poles to [1] a beech, ironwood and dogwood, thence North 80 poles to [2] a stone and persimon standing in a glade, thence West 100 poles to [3] three beeches, thence North 80 poles to [4] two beeches and ash, thence West 192 poles to [D] a sugar tree and walnut in Truman's line, thence with the same South 25° East 180 poles to the beginning to have and to hold the said 210 acres of land with all and every singular the appurtenances thereunto belonging unto the said Giles Davis his heirs and assigns forever, and the said John Whitaker and his wife Mary Whitaker do hereby covenant and agree that they are seized of an indefeasible and absolute right of inheritance in the said 210 acres of land and that they will forever warrant and defend the same unto the said Giles Davis his heirs and assigns against the claims of all persons under and by me.
