John & Mary Whitaker to Moses Davis - 162 Acres

On 13 Aug 1796, John and Mary Whitaker sold a tract of 162 acres to Moses Davis, as shown below. This land lay on the waters of Cedar Creek, a branch of Salt River, which was patented by Whitaker on 3 Jan 1788, based upon a survey completed by Thomas Whitledge on 27 Feb 1783.

This indenture made this 13th day of August 1796 between John Whitaker and his wife Mary Whitaker of Shelby County of the one part and Moses Davis of Nelson County of the other part both of the state of Kentucky, witnesseth that said John and Mary Whitaker for and in consideration of the sum of 48 £ 12 shillings to him in hand paid before the sealing and delivery of these presents, the receipt whereof the said John and Mary Whitaker doth hereby acknowledge, hath granted, bargained, sold and by these presents doth grant, bargain, sell and confirm unto the said Moses Davis and his heirs forever all their right, title, interest and claim to a certain tract or parcel of land containing 162 acres lying and being in the county of Nelson and on the head branch of Cedar Creek waters of Salt River adjoining said John Whitaker's 460 acre tract on the east and John Frigg's 250 acre survey on the west side and bounded as followeth, viz. Beginning at a gum and poplar a south east corner said Whitaker's 460 acre tract, thence along his line North 10° West 50 poles to a hickory, ash and dogwood, thence North 80° East 108 poles to an ash and small black oak near a fork of a branch in the line of John Frigg's 250 acres survey, thence along his line South 30° East 160 poles to a stooping white oak on a ridge, thence South 82° West 227 poles to a hickory and white oak at the foot of a knob, thence North 10° West 110 poles to two white oaks, thence North 80° East 40 poles to the beginning with its appurtenances to have and to hold the said tract or parcel of land with its appurtenances to the said Moses Davis and his heirs forever and assigns the said John and Mary Whitaker and his heirs from the claim of all and every person or persons whatsoever shall and will warrant and forever defend claiming from or under me from my heirs or assigns and if the above described land should be taken away from said Moses Davis by any older right whatsoever or from said Moses Davis's heirs or any of them then said John Whitaker or his heirs shall well and truly pay or cause to be paid the above mentioned money back again unto said Mose Davis, his heirs or any of them.
