In December 1847, Frederick Travis mortgaged several pieces of property, including 4 Shepherdsville town lots, to Henry C. Thomas and George W. Bowman in exchange for their standing as his security as guardian of John Henry Holloway. The Shepherdsville lots (81, 82, 83, 84) stood on the north side of Third Street between West Street and Plumb Steet at that time.
Bullitt County Deed Book L, Page 219
This indenture made this 16th day of December 1847 between Frederick Travis of Bullitt County, Kentucky of one part and Henry C. Thomas and George W. Bowman of the other part.
Witnesseth that whereas said Henry C. Thomas and George W. Bowman are the securities of said Frederick Travis, guardian to John Henry Holloway, appointment made the 19th May 1845 by Bullitt County Court, Ky. And said Frederick Travis, guardian as aforesaid, is desirous to secure said Thomas and Bowman and indemnify them fully as the securities aforesaid against any loss on account thereof. Wherefore in consideration of the premises and of one dollar to said F. Travis paid by said Thomas & Bowman, he said Frederick Travis has sold and conveyed and by these presents does sell and convey unto them the said Thomas and Bowman and their heirs forever the following real estate in and near and adjoining the town of Shepherdsville, Bullitt County, Ky., viz:
Lots Nos. 81, 82, 83, 84 in the new plan of said town added from that part of the Third Street sold.
And also the four acre lot of ground and appurtenances adjoining said lots, the same whereon said Travis brick house is situated; also the two four acre lots adjoining said first named 4 acre lot, and also the ten acre lot of land adjoining same, or the interest and right of said Travis to same unsold, with the appurtenances to said lots and lands belonging.
To have and to hold the said lots and lands aforesaid unto them said Thomas and Bowman and to their heirs forever against the claims of all persons whatever.
It is understood the legal title to the four first named lots in town, and the four acre lot adjoining thereto with its improvements is in Jacob W. Bowman and said Travis holds the bond of said Bowman for a release and deed to said lots on the payment of the balance due said Bowman by said Travis, and this mortgage conveys said lots and land subject to the amount due to said Bowman, and also conveys the said other lots of land subject to the balance of the purchase money due by Travis for same.
And this conveyance and mortgage is made on this condition, to-wit: If said Travis shall at all times now and hereafter save harmless and indemnify them, said Thomas and Bowman in their securityship, and in case said Bowman and Thomas shall ever be made liable or ever have anything to pay for or on account of said securityship, then the property herein conveyed to be held liable therefore.
The meaning of this mortgage is, and the parties hereto agree, that the property herein mortgaged is to secure and fully indemnify them, said Bowman and Thomas on account of their said securityship for and to him said Travis, guardian to said Holloway aforesaid. And if and when said securities are released and fully discharged from any and all loss as aforesaid, then this deed to be void, else to remain in full force and virtue. Witness the hand and seal of said Travis the date first herein written. (signed) Frederick Travis.
