This Circuit Court suit is referenced in deeds from Catherine Newkirk to William Shain, and from William Shain to Thomas Joyce.

This day this cause came on to be heard on the pleadings and exhibits in the cause, and the Court being sufficiently advised orders and decrees that a judgment be entered in favor of N. Simmons as assignee of Shain against R. F. Joyce and Thomas Joyce for the sum of $575 with interest at the rate of 6% per annum from the 25th day of December 1855 till paid; and the further sum of $575 with interest thereon from 25 December 1855 at the rate of 6% per annum till paid.

It is further decreed and ordered that the cross petition of Shane against Catherine Smith (now Newkirk, she having sine the last term of this court intermarried with Asa H. Newkirk) be taken as confessed against her, and that she convey to defendant William Shane one undivided half of the tavern house and lots in contest in this suit by deed of general warranty conditioned to defend the title to said lot to the extent of estate that she may have received or may hereafter receive of her deceased husband John S. Smith to the extend of one half the purchase money of said tavern house and lots, and on her failure to make said conveyances on or before the 6th day of this term R. F. Samuels is appointed commissioner to made said conveyance in her room and stead.

It is further decreed and ordered that the defendant William Shain convey to Robert F. Joyce the lots and tavern house thereon in Shepherdsville according to his bond (defendant exhibit A) filed in this suit dated 25 December 1855 on or before the 6th day of this term, and on his failure to make said conveyance by deed in fee simple with general warranty, R. F. Samuels is appointed commissioner to make said conveyance in his stead.

On said conveyances being made and lodged with the clerk of the Bullitt County Court for record, Simmons may have execution for his debt and interest aforesaid. Simmons is to pay Joyce his costs in this expended; Shain is to pay Simmons his costs herein expended including the costs Simmons pays Joyce. The several parties may have execution for their costs.

By consent of Robert F. Joyce in court, Shain's conveyance of the house and lots to be made to Thomas Joyce instead of Robert F. Joyce.
