Andrew L. Roger to Adam Shepherd - Two Tracts

As the result of a Circuit Court case, the two tracts sold by Adam Shepherd to James McKeever whose heirs sold them to Andrew Lewis Roger were now to be sold again, and Adam Shepherd was the purchaser as shown below. The tract that lay mainly in the river bed also included Shepherdsville lots 65-76. Shepherd would then sell the two tracts to John W. Beckwith and Frederic W. S. Grayson.

This indenture made this 30th day of March in the year of our Lord 1813 between Joseph Hough, deputy sheriff For Christian James Sanders, sheriff of Bullitt County of the Commonwealth of Kentucky of the one part and Adam Shepherd of the same county and Commonwealth of the other part.

Witnesseth that on the 11th day of June in the year 1812 an execution Fifa or Fieri facias issued from the clerk's office of the Bullitt Circuit Court at the suit of Martin H. & W. Wickcliffe against the estate of Andrew L. Roger, James Alexander, and Adam Shepherd in the words and figures following, to-wit.

The Commonwealth of Kentucky to the sheriff of Bullitt County, greeting. We command you that of the estate of Andrew L. Roger, James Alexander and Adam Shepherd lte of your bailiwick you cause to be made the sum of $745.66 with interest thereon after the rate of 6% per annum from 28 August 1811 be paid which Martin H. & W. Wickcliffe lately in our Bullitt Circuit Court hath recovered against them for debt; also the sum of one penny and $11.54 which to the said Wickliffe lately in our said court was adjudged as well for their damages which they have sustained by reason of the detention of the said debt as for their costs by them expended whereof the said Roger, Alexander and Shepherd are convicted as appears to us of record, and that you have the $745.66 & $11.45 1/2 before the judges of our said court on the first Saturday after the first Monday in August next to render to the said Wickliffe their debt, interest and costs aforesaid. And have then there this writ. Witness, Fred W. S. Grayson, clerk of said court at the courthouse in Shepherdsville this 11th day of June 1812, and in the 21st year of the Commonwealth. (signed) F. That the said execution was afterwards, to-wit, on the 19th day of June in the year 1812 delivered to the said deputy sheriff to execute that there being no slaves or personal property upon which to levy said execution except a quantity of brick, the said deputy on the __ day of __ in the year aforesaid levied the same on said brick lot, two tracts or parcels of land lying in said county on Salt River adjoining and below Shepherdsville and adjoining each other, one of them containing 150 acres of land, more or less, and bounded as follows.

Beginning at two black walnuts and three mulberry saplings on the north bank of Salt River, thence South 79° East 240 poles to a black or red oak, elm and sweet gum saplings in a flat, thence South 6°30' West 49 poles to a stake, corner to the grave yard, thence with a line of the same North 83° West 25 poles to another stake, thence South 6°30' West 6 poles to another stake, thence South 83 1/2° East 25 poles to a stake, thence South 6°30' West 26 poles to a line of said Shepherd's 600 acre survey on the bank of Salt River, thence down said river and binding thereon with the several meanders thereof to the beginning.

The other containing 50 acres, more or less, and bounded as follows. Beginning at the upper line of the aforesaid 150 acres aforesaid at the junction of the lower line of Water Street, thence with the said street line up the river as far as Walnut street, thence with said street to the river, thence up the river to a large beech tree marked A.S., corner to Peter Shepherd's 600 acre survey, thence with the line thereof South 36° West to the south side of Salt River and so far up the bank thereof as shall be seven feet perpendicular height above low water mark, thence down said river at the distance aforesaid to opposite the beginning corner of the aforesaid 150 acre tract, thence crossing the river to the beginning corner, thence up the river with the lines of the aforesaid tract of 150 acres to the beginning.

That the said deputy sheriff levied the said execution upon the said tract of land as the property of the said Andrew L. Roger, he being seized and possessed thereof; that the said deputy not having time to advertise and sell the said tracts of land under said execution so returned the same to the clerk's office aforesaid from which on the 14th day of August in the year aforesaid an execution venditione espones in the name of said Martin H. & N. Wickliffe against said Roger, Alexander and Shepherd issued in these words.

The Commonwealth of Kentucky to the sheriff of Bullitt County, greeting. We command you to expose to sale that estate of Andrew L. Roger, James Alexander and Adam Shepherd to the value of $745.66 with interest thereon after the rate of 6% per annum from the 28th of August 1811 till paid and _ in damages cash $12.25 1/2 which according to our commands you have taken into your hands and which remains in your hands unsold as you have certified to our judges of our Bullitt Circuit Court to satisfy Martin H. & N. Wickliffes the sums aforesaid whereof in our said court they have recovered execution against the said Roger, Alexander and Shepherd by virtue of a judgment in our said court and that you have the same before the judges of our said court on the first Saturday after the first Monday in February next to render to the said Wickliffes, their debt, interest and costs aforesaid. And have then there this whit. Attest: Frederick W. S. Grayson, clerk of our said court at the courthouse in Shepherdsville this 14th day of August 1812 and in the said execution was on the 14th day of August in the year aforesaid was delivered to the said deputy to execute who after advertising the time and place of sale as required by law, and after selling the said brick for the sum of $138.25 and the said dependents still failing to discharge said execution or any part thereof pursuant to advertisement on the the 15th day of August in the year aforesaid between the hours of eleven in he morning and three o'clock in the afternoon at public auction in market overt at the most conspicuous places on the premises sold the said tracts of land to the said Adam Shepherd the highest bidder for the sum of $372 current money, to-wit the said tract of 150 acres upon the bank of Salt River at the house of said Roger and the said tract of 50 acres upon said tract under the said bank opposite said house that the said tracts of 150 acres and of 50 acres, more or less, were sold with their appurtenances by the said deputy to the said Adam Shepherd, his heirs and assigns forever for the said sum of $372 current money as aforesaid upon a credit of three months, the purchaser to give bond with good security for the payment there and that thereupon the said Adam Shepherd accordingly with Benjamin Shapone, his security, entered into and executed their bond for the payment of the said sum of $372 as the law directs, which bond has been returned to and is now filed in the office aforesaid now in consideration of the premises and of the sum of one dollar by the said Adam to the said deputy in hand paid, the receipt whereof is hereby acknowledged the said deputy hath given, granted, bargained and sold, and by these presents doth give, grant, bargain and sell, alien, release, convey and confirm unto the said Adam Shepherd all the right, title and interest of the said Andrew L. Roger and his heirs in and to the said tracts of 150 and 50 acres of land, more or less, with their appurtenances.

To have and to hold the same to the said Shepherd his heirs and assigns forever. In witness whereof the said deputy hath herewith set his hand and affixed his seal the day and year first above written.
