Thomas W. Riley to Hamilton C. Ulen - Shepherdsville Lots 35-36

On 20 Feb 1844, Thomas Riley sold Shepherdsville lots 35-36 to Hamilton C. Ulen, as shown below. On 29 Jan 1839, John J. Thomasson and Noah C. Summers had sold the two lots to Riley.

On 10 Aug 1846, Ulen mortgaged the two lots to Wilford Lee as part of an arrangement in which Lee paid the remaining $100 due to Riley. This mortgage is shown further down this page.


Bullitt County Deed Book K, Pages 531-532

This indenture made the 20th day of February in the year of our Lord 1844 between Thomas W. Riley and Kate, his wife of the county of Nelson and state of Kentucky of the one part and Hamilton C. Ulen of Shepherdsville, Kentucky of the other part.

Witnesseth that the said Thomas W. Riley for an in consideration of the sum of $110 to be paid in 12 months from this date for which the said Ulen has this day executed his note to the said Riley, has granted and sold and does hereby sell and convey to the said Ulen two vacant lots in the town of Shepherdsville known by the numbers 35 and 36 in the new plan of said town containing about 1 acre more or less, and the said Riley does hereby covenant and agree to and with the said Ulen that the title ot the said two lots No. 35 & 36 he will forever warrant and defend to the said Ulen, his heirs &c forever against the claim of all and every person or persons whatsoever.

In testimony whereof the said Riley and wife have hereunto set their hands and affixed their seals the day and date first above written.

This indenture made and entered into 10th day of August 1846 between Wilford Lee of Bullitt County and H. C. Uen of the same county and state.

Witnesseth that the said Ulen for and in consideration of the sum of $625 paid and settled by the said lee for said Ulen as followeth: $325 paid to Ormsby Hite & Co.'s attorney, $160 paid to George Philips, and $40 paid to William R. Thompson, attorney for William A. Hill, and $100 to be settled with Thomas W. Riley in cash notes, which last named sum is the balance of the purchase money due Riley by Ulen for two lots in Shepherdsville known by their numbers 35 & 35.

Now in consideration of the premises above, the said Ulen hath this day, and doth by these presents sell and convey to the said Lee the above named two lots with all the appurtenances thereunto belonging.

To have and to hold the same to the said lee's only use and benefit, and the said Ulen will, and his heirs shall forever warrant and defend the title to said lots to the said Lee against all claims whatever, but should the said Ulen or any one for him pay said Lee the sum of $625 with interest from date within twelve months from this day, then these presents are to be null and void, [otherwise] to remain in full force and virtue, as witness the hand and seal of the grantor. And George Phillips becomes a party to this deed so far only as to release all title and claim he has to the lots No. 35 & 36 mentioned in the within deed; said lots having been mortgaged to said Phillips by said H. C. Ulen in Bullitt County Court Office. And said Phillips acknowledges satisfaction of said deed of mortgage so far as the same affects said lots. And this deed of release is made without warranty on him said Phillips, except to release any claim he has to said lots aforesaid. August 10th, 1846. (signed) George Phillips
