Heirs of Robert F. Samuels to John D. Ryan - Small Lot Near Shepherdsville

The tract transferred by this deed was sold by Henry J. Craycroft to the L & N Railroad via Bullitt County deed [Deed Book N, page 226], and then by the railroad to Robert F. Samuels [Deed Book O, page 570]. In this deed below, it is being sold to John Ryan by the court to pay Samuels' creditors.

Whereas heretofore, to-wit, on the 12th February 1863, Charles R. Samuels, executor of the last will and testament of Robert F. Samuels dec'd, instituted a suit in equity in the Bullitt Circuit Court of Kentucky against the devisees under the said will, asking a sale of as much of the real estate of said decedent as might be necessary to pay the debts of said estate, the personalty not being sufficient, and on the __ day of __ 186_ said Charles R. Samuels resigned his executorship and the estate of said decedent was ordered into the hands of Wesley Phelps, then sheriff of Bullitt County, and on the 18th April 1865 the aforesaid suit was ordered to be prosecuted in the name of said Wesley Phelps, curator of the estate of said decedent, and on the 23rd April 1868 a judgment was rendered in said suit directing that the land in the petition mentioned that then remained unsold be sold as directed in the judgment directing its sale, rendered the 22nd April 1863, it appearing to the court that said sale was necessary to pay the debts against decedent's estate.

Wilhite Carpenter was appointed a commissioner to carry said judgment into effect, and after advertising the sale as by the judgment directed, he on the 21st September 1868, being Bullitt County Court day, exposed for sale at the courthouse door in Shepherdsville, Kentucky the lot supposed to contain two and one half acres belonging to the estate of said decedent and situated in or near the town of Shepherdsville, and John D. Ryan being the highest and best bidder became the purchaser of same at the price of $175 and executed his two bonds, each for a moiety of the purchase money, payable to said commissioner in 6 and 12 months, and on the 28th day of October 1868, the report of sale was confirmed, and on the 11th June 1869, the curator aforesaid was ordered to collect said bonds, and on the 6th September 1869 he collected the one first due, and on the 30th October 1870 obtained a rule on said Ryan to show cause why he had not paid the second one. And on the 18th April 1870, Ryan filed his response to said rule and the same being submitted it was on the 19th April 1870 adjudged by the court that the said Ryan have a credit on his second bond to the extent of $60, owing to a deficiency in the amount of land purchased by him, it appearing that said lot only contains 1 acre, 2 roods and 10 1/2 poles, and it appearing from the record in said case that said Ryan had fully paid off the balance of said second bond, Casper Herps was on the 17th October 1870 appointed the commissioner of the court to convey said lot of land to said Ryan, and on the 24th October 1870, said Herps was removed and Richard McConathy appointed the commissioner of the court for the purpose named in his stead.

Now this deed made this 27th day of October 1870 between Thomas W. Samuels and Hugh M. Samuels, Robin J. Samuels, Fanny Samuels and Kate Samuels, children of Kate Samuels dec'd, Mary Samuels, widow of C. R. Samuels dec'd and their children, Kate Samuels, Phil Lee Samuels and Josie Samuels by Richard McConathy, commission, parties of the first part and John D. Ryan party of the second part.

Witnessth that the first parties for and in consideration of the premises and the payment of the aforesaid bonds to Wesley Phelps, curator of the estate of R. F. Samuels dec'd, the parties of the first part by the aforesaid commissioner doth hereby grant, bargain, sell, convey and confirm unto the second party the aforesaid lot of ground which from the survey of Casper Herps, made part of the aforesaid record, is bounded as follows, to-wit.

Beginning at a stake being 80 feet in a direct line from the northwest corner of lot No. 11 of the town plan of Shepherdsville, thence with the eastern line of Doctor's Alley 198'10" to a stake, thence parallel with a line of Third Street eastwardly 21 poles, 3 links to a stake 30 feet from the center of the railroad, thence with the railroad line southwardly 12 poles, 2 links to a stake in a line of Third Street as originally laid off by Adam Shepherd, thence with said line southwardly 80 feet from the town line and parallel with said line 20 poles, 10 links to the beginning, being that portion of the land east of the Louisville and Nashville Railroad sold by H. J. Craycroft to the Louisville and Nashville Railroad Company [Bullitt County Deed Book N, page 226], and by it to Samuels [Bullitt County Deed Book O, page 570].

Witness the signatures of the parties of the first part by the aforesaid commissioner this 27th October 1870.
