Samuel Neill to Charlotte G. Benthall - 120 Acres

Charlotte Benthall, as the trustee of Sarah Shepherd Benthall and Julia Monroe Neill, and Samuel Neill petitioned the county court to divide a tract of land between them. This is the part that was granted to Benthall.

Whereas by an order of the Bullitt County Court made the 16th day of August 1852 by W. B. Holsclaw, James Combs and C. Clay Kalfus were appointed commissioners to divide a tract of land in Bullitt County between Charlotte G. Benthall, the said Charlotte being the trustee of Sarah Shepherd Benthall and Julia Monroe Neill and Samuel Neill, and the said commissioners having been first duly sworn made partition of the said tract of land between the said Charlotte G. Benthall of the one part trustee as aforesaid and Samuel Neill of the other part, and having made report to said court of said division and said report being approved by said court and ordered to record and the said commissioners having been appointed by said court to convey the said land according to the partition as shown by said report.

Now in consideration of the premises, this indenture made this 15th day of January 1853 between Samuel Neill as aforesaid by William Burkhead Holsclaw and James Combs, two of the commissioners aforesaid of the one part and Charlotte G. Benthall, trustee as aforesaid, of the other part.

Witnesseth that the said Samuel Neill by William B. Holsclaw and James Combs, commissioners as aforesaid, hereby transfers, aliens and conveys to the said Charlotte G. Benthall, trustee as aforesaid, all that portion of the tract of land aforesaid, bounded as follows.

Beginning at a stake in the county road leading from Bardstown to the Long lick bridge and running North 57 1/2° West 43 poles to another stake in said road, thence North 75° West 43 poles to a beech and hickory both fallen down on the side of a knob thence South 23° West 156 poles to three beeches Glass' corner, thence with Glass' line South 35° East 72 poles to a beech, thence South 55° West 23 poles to a rock, dogwood and elm in the road at a branch, thence up said branch with its meanders South 32 1/2° East 24 poles, South 11° East 42 poles, South 10° East 34 poles to a beech in Rude's line, thence with his line North 65° East 8 poles to Rude's corner three dogwood, two poplar and a beech, thence North 84° East 60 poles to a beech, Hickory and hoop pole, which is a corner made in this division, thence North 12 1/2° West 137 poles to a stake in a field, thence North 26° East 150 poles to the center of Neill's spring branch 7 links North 41 1/2° West of a box elder by the side of said spring, thence North 41 1/2° West four poles to a stake, thence North 35° East 5 poles to the beginning containing by calculation 137 acres.

To have and to hold the said tract of land in the above boundary together with the appurtenances thereunto belonging to the said Charlotte G. Benthall, trustee as aforesaid. And the said Samuel Neill by William B. Holsclaw and James Combs, commissioners as aforesaid, hereby releases, transfers and conveys by quit claim to the said Charlotte G. Benthall, trustee as aforesaid, the land embraced in the boundary above set out and the commissioners aforesaid incur no personal responsibility hereby. In testimony whereof the said Samuel Neill by William B. Holsclaw and James Combs, commissioners as aforesaid, hereto set his hand and affixed his seal the date above.
