Jacob Myers to Joseph Brooks, 1795

On 5 Oct 1795, Jacob Myers of Bourbon County sold three tracts of land to Joseph Brooks of Bullitt County. These tracts lay to the west of tracts claimed by Edward Williams and Robert Shanklin in northern Bullitt County.

The first tract, containing 400 acres, began at "a white gum and elm standing by a branch in the Knobs, west of Clears Station," marked with the letter A on the drawing shown here. Its boundary traveled east to the northwest corner the 50 acre tract, and followed the west and south lines of that tract to the line of Robert Shanklin where it traveled south, then west, and finally north back to the beginning.

The second tract, containing 500 acres, lay to the north of the 400 acre tract. Its boundary began at the same place (letter A) and traveled east "to a large poplar and black oak," that marked the corner of Robert Shanklin and Edward Williams' property (letter B on the drawing). From there it followed Williams' line northward, then turned west and then south, before returning eastward to the beginning.

The final tract, containing 50 acres, began at the Williams / Shanklin corner (letter B) and made a square boundary, traveling south, then west, north, and east back to the beginning. The deed made a point of mentioning that this 50 acre tract included Clear's Station.

This indenture made this fifth day of October in the year of our Lord one thousand seven hundred and ninety five, Between Jacob Myers of the County of Bourbon and State of Kentucky of the one part and Joseph Brooks of the County of Jefferson and State aforesaid of the other part. Witnesseth that the said Jacob Myers for and in consideration of the sum of one hundred and forty pounds specie current money to him in hand, paid by the said Joseph, the receipt whereof is hereby acknowledged hath granted, bargained, sold, aliened and confirmed, and by these presents doth grant, bargain, sell, alien, and confirm unto him the said Joseph Brooks two certain tracts or parcels of land, the one containing four hundred acres, the other five hundred, granted to the said Jacob by the Commonwealth of Virginia by patents bearing date the 2nd day of December 1785 and the __ day of __ lying in the said County of Jefferson on the waters of Floyds fork, adjoining the said Myers 50 acre tract, the first of which is bounded as follows, viz, Beginning at a white Gum and Elm standing by a branch in the Knobs, west of Clears Station, and running East one hundred and twenty two and a half poles to a Sugartree and Ash, corner to the said 50 acre tract, then with the lines thereof South eighty nine and a half poles to a Beech, then East eighty nine and a half poles to a red Oak and Sugartree in Robert Shanklings line, and with said line South two hundred fifty & half poles to a red Oak, Sugartree and beech, then West two hundred and twelve poles to a Sweet gum and beech, then North three hundred and forty poles to the Beginning - also the said five hundred acres Beginning at a white Oak, gum, & Elm standing by a branch, N. W. corner of the said 400 acres, then East two hundred and twelve poles to a large poplar and Black Oak, corner to the said Shankling and Edward Williams, then with Williams line North three hundred and twenty four poles to a White Oak, Elm and Beech in Major Beasleys line, thence West two hundred and forty six & 3/4 poles to a White Oak, then South three hundred and twenty four poles to a White Oak, then East 34 3/4 poles to the Beginning. To have and to hold the said two tracts or parcels of land with their appurtenances to the use and befoof of him the said Joseph, his heirs, assigns - and the said Jacob doth covenant and agree to and with the said Joseph that he the said Jacob, his heirs, exors &c shall warrant & defend the said two tracts or parcels of land with their appurtenances unto the said Joseph, his heirs & assigns against the claim of him the said Jacob and his heirs, or any person claiming under him or them. In witness whereof the said Jacob hath hereunto set his hand and affixed his seal the day & year first above written.

This indenture of Bargain and Sale from Jacob Myers to Joseph Brooks was proved by the oaths of Alexander Breckinridge, Robert Breckinridge and John Drake, three of the subscribing witnesses thereto and order to be recorded.

This indenture made this fifth day of October in the year of our Lord one thousand seven hundred and ninety five, Between Jacob Myers of the County of Bourbon and State of Kentucky of the one part and Joseph Brooks of the County of Jefferson and State aforesaid of the other part. Witnesseth that the said Jacob Myers for and in consideration of the sum of thirty six pounds specie current money to him in hand, paid by the said Joseph, the receipt whereof is hereby acknowledged, hath granted, bargained, sold, aliened & confirmed and by these presents doth grant, bargain, sell, alien and confirm unto him the said Joseph a certain tract or parcel of land containing fifty acres granted to the said Jacob by the Commonwealth of Virginia by patent bearing date the nineteenth day of May 1785, lying in the County of Jefferson on the waters of Floyds fork & on the west side of the road from the Salt Works to the Falls, and about four mile from the said Works, and bounded as follows, Viz. Beginning at a large poplar & black Oak near to Edward Williams & Robert Shankling and running with Shanklings line South eighty nine & a half poles to a red Oak & Sugartree, thence West eighty nine & a half poles to a Beech, thence North eighty nine & a half poles to a Sugartree & ash, thence East eighty nine & a half poles to the Beginning, including the place called Clears Station. To have and to hold the said tract or parcel of land with its appurtenances to the use and behoof of him the said Joseph, his heirs and assigns forever. And the said Jacob, his heirs, Exors &c shall and will warrant and forever defend the said tract or parcel of land with its appurtenances unto the said Joseph, his heirs and assigns against the claim or claims of all person whatsoever. In witness whereof the said Jacob hath hereunto set his hand and affixed his seal the day and year first above written.
