Henry Oldham Maraman to Wilhite Carpenter - Ferry Site

This deed, written on 29 May 1849, transferred land on both sides of Salt River near Shepherdsville from Henry O. Maraman to Wilhite Carpenter including the ferry landing site.

This indenture made this 29th day of May in the year of our Lord 1849 between Henry O. Maraman of the County of Bullitt and state of Kentucky of the first part and Willhite Carpenter of the county of Bullitt and state of Kentucky of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of three hundred dollars to the said party of the first part by the party of the second part, in hand paid, the receipt whereof is hereby acknowledged, has granted, bargained and sold, and by these presents doth grant, bargain, alien, sell, convey and confirm unto the said party of the second part, his heirs and assigns forever all the following described pieces or parcels of land on the south side of Salt River beginning at the fork of the Bardstown and Elizabethtown roads, thence down the same to the said Carpenter line, thence with said line to the river, thence up the river to the mouth of the first big holler above the ferry (say 100 yards above the same), thence with the main hollers to the beginning containing ten acres more or less. Also the ferry privileges on the north side of Salt River, to wit: one half acre commencing at low water mark at the landing to be double the length on the river to what it is on the hill and also a road through the lands of Barth reserved by Maraman in his sale to him Barth, together with all the rights, privileges and appurtenances thereto belonging. To have and to hold the above described with all the improvements and appurtenances to the same belonging to the said party of the second part, his heirs and assigns forever. And the said party of the first part for himself and his heirs does hereby covenant with the said party of the second part and his heirs that he is lawfully seized in fee of the premises aforesaid and have good right, full power and lawful authority to sell and convey the same in manner aforesaid and that he will forever warrant and defend the same, and the quiet and peaceable possession thereof together with the appurtenances to the same belonging or appertaining unto the said Willhite Carpenter, heirs or assigns against the lawful claims of all persons whomsoever. In witness whereof the said Henry O. Maraman and Elmire his wife who hereby relinquishes her right of dower to the above described premises, have hereunto set their hands and seals the day and year first above written. (signed) H. O. I Noah C. Summers, clerk of the county court for said county, certify that this deed from Henry O. Maraman and Elmira E. Maraman his wife to Willhit Carpenter was the 29th of May 1849 acknowledged before me in my office by the said Henry O. Maraman and on the 1 June 1849 acknowledged by the wife to be their act and deed. And she the said Elmira E. Maraman, being examined by me separately and apart from her said husband, declared that she did freely and willingly seal and deliver said deed and wished not to retract it, and acknowledges said deed again shown and explained to her to be her voluntary act and deed and consented that the same might be recorded. And thereupon the said deed and this certificate are truly recorded in my said office this 5th day of June 1849. Att. N. C. Summers, CBCC
