Hornbeck & Others to John Anderson - 231.25 Acres

On 1 Mar 1822, John Anderson purchased 241.25 acres on the waters of Brooks' Run, most of which had been a part of the patented lands of Edward Williams that had been purchased by Isaac Hornbeck. That part passed to Isaac's son John. Under a circuit court order, John Hornbeck's portion was sold at auction to John J. Jacob and Thomas Prather who had not yet received a deed to it.

The remainder was a part of the lands claimed by the heirs of John Larue who had sold their rights to it to Robert Breckenridge, William Pope Jr. and Worden Pope.

This indenture made this first day of March 1822 between John Hornbeck and Sally his wife of the county of Bullitt in the state of Kentucky of the first part, Thomas Prather and John J. Jacob of the town of Louisville, county of Jefferson, and state aforesaid of the second part, Robert Breckenridge, William Pope Jr. and Worden Pope of the said county of Jefferson of the third part and John Anderson of the said county of Bullitt of the fourth part.

Witnesseth that the parties of the first, second and third part for an in consideration of the sum of $2412.50 to them in hand paid and secured to be paid in the proportions herein after specified to each of the said parties, have granted, bargained and sold, aliened, released, enfeoffed, conveyed and confirmed, and by these presents do grant, bargain and sell, alien, release, enfeoffe, convey and confirm unto the said Anderson and to his heirs and assigns a certain tract or parcel of land with all the appurtenances containing 241 1/4 acres lying and being in the said county of Bullitt on Brooks' Run and its waters, and bounded as follows to wit.

Beginning at [A] a bush and a large rock marked I.A. planted on the east bank of Brooks' Run in a line of Williams and Shanklins' line and with same West 165 poles to [B] a large rock marked I.A., a white oak and box elder, thence North 248 1/2 poles to [C] a black gum, maple and a large rock marked I.A., thence East 128 poles to [D] two thorn bushes and a large rock marked I.A. standing on the east bank of Brooks' Run, thence South 24 3/4° East 56 poles to [E] a white oak, walnut, red oak and a cliff of rocks marked I.A., thence South 2° West 30 poles to [F] a large rock marked I.A. standing on the east bank of Brooks' Run, thence South 27 1/2° East 18 poles to [G] a large rock marked I.A. standing on the east bank of Brooks' Run, thence South 7 3/4° West 32 poles to [H] a hickory, red oak and a rock marked I.A. standing on the east bank of Brooks' Run, thence South 10° East 104 poles to [I] a cliff of rocks marked I.A. on the east bank of Brooks' Run, thence South 28 1/2° West 18 1/2 poles to the first beginning, containing 241 1/4 acres, it being part of the preemption of Edward Williams and was claimed and held under that title by the said John Hornbeck and 180 acres thereof were sold as the property of the said Hornbeck under an execution of the Bullitt Circuit Court by the Sheriff of Bullitt County, and the said Jacob purchased the same for himself and the said Prather, but never received a deed therefore.

The parties of the third part also claimed the said land under a patent for 21,000 acres patented in the name of the heirs of John Larue dec'd, and deeds of conveyance from those heirs and the parties of the first, second and third parties have united all their claims aforesaid in the sale of this conveyance to the said Anderson, the said party of the first part receiving of the purchase money, the sum of $947.25, and are to bind themselves by covenant of general warranty for the whole tract, the said party of the second part receiving of the purchase money the sum of $1050, and are to be bound by covenant of general warranty to the extent of and limited by that sum, and the party of the third part receiving of the purchase money the sum of $415.25 and are to be bound by covenant of general warranty to the extent of and limited by that sum, and the said Anderson has this day executed and delivered to the party of the second part his note for the sum of $525, being the last half unpaid of their part of the purchase money made due and payable the first day of March next with lawful interest thereon from this date, also has this day executed and delivered to the party of the third part his note for the sum of $207.62 1/2, being the last half unpaid of their part of the purchase money made due and payable and with interest as aforesaid, but of the principal in each note shall be punctually paid the interest shall not be claimed or paid and shall be released and the parties shall have and hold and a lien is hereby reserved and given on the said land for the security and payment of the said notes; and all the estate, right, title, claim, interest and fee of the parties of the first, second and third parties of in and to the said 241 1/4 of the said land with all the appurtenances.

To have and to hold the same unto the said Anderson and to his heirs and assigns to his and their only proper use and behoof forever; and the party of the first part covenants and agrees with the said Anderson and with his heirs and assigns to warrant and forever defend the said tract or parcel of land with all the appurtenances to him and them against all and every person or persons whatever. And the parties of the second part covenant and agree with the said Anderson and with his heirs and assigns to warrant and forever defend the said tract or parcel of land with all the appurtenances unto him and them against all and every person or persons whatever to the extent and no further of the purchase money received by teh party of the second part and the parties of the third part, covenant and agree with the said Anderson and with his heirs and assigns to warrant and forever defend the said tract or parcel of land with all the appurtenances unto him and them against all and every person or persons whatever to the extent and no further of the part and share of the party of the third part of the purchase money received and to be received by them as aforesaid. The words "of land" on this page interlined. In witness whereof the parties to these presents have hereto set their hands and seals on the day and year first written.
