H. O. Maraman to John H. Napper - 159 Acres

On 31 Jan 1877, Henry O. Maraman sold 159+ acres of his farm to John H. Napper. Because the land was part of land mortgaged by Maraman to the Mercantile Trust Company of New York, the payments from Napper were to go to the Trust Company.

This indenture and deed of conveyance made and entered into the 31st day of January 1877 by and between Henry O. Maraman and Elmira his wife of the county of Bullitt and state of Kentucky of the first part, and John H. Napper of Bullitt County and state of Kentucky of the second part.

Witnesseth that for and in consideration of the sum of $3893.50, $316 in hand paid, receipt whereof is hereby acknowledged, and the balance $3577.50 to be paid as herein after recited, the parties of the first part have granted, bargained and sold and by these presents grant, bargain and sell unto the party of the second part, his heirs and assigns the following described tract of land in Bullitt County, Kentucky, to wit: being part of the farm of said Maraman on the south side of Salt River near Shepherdsville and described as follows.

Beginning at a cedar post corner to W. Carpenter, thence with his lines South 25 1/2° West 38 1/2 poles to a cedar post near to W. Carpenter's and Hatzel, thence with Hatzel's lines South 13° West 15 1/4 poles to a stake, thence South 76 1/2° East 56 poles to a maple and red oak (both down), thence South 1° West 65 3/4 poles to a stake about 10 feet eastward from an elm, thence South 70° West 22 1/3 poles to a stake in Hatzell's line, thence South 16 1/2° East 49 poles to a stake, thence North 66 1/4° East 85 poles to a stake in the center of Maraman's fence where it adjoins William Buckman's fence, supposing to be in the old line, thence with the old line North 19° West 42 poles to a beech, William Buckman's corner, thence with his line North 72° East 48 poles to a gum and red oak in a line of Charles Lee's heirs, being the original patent line of Pope and Froman's 400 acre survey, thence with the same North 21 3/4° West 179 poles to a stake in the Shepherdsville Road where said line crosses the road, thence down the road South 86 3/4° West 72 poles, North 87 33/4° West 37 poles to a stake on the southeast edge of the road, thence South 62° West 14 poles to the beginning, containing 159 1/4 acres, more or less.

And whereas on 2 April 1875 the parties of the first part gave to Louis Fitzgerald, trustee of the Mercantile Trust Company of the city of New York a mortgage upon the land herein above described, and upon other lands amounting in the aggregate to 675 acres to secure the payment of $5000 due and payable five years after the date of said mortgage, and the interest on which at the rate of 7% per was payable semiannually on the first days of February and August of each year and with the further provision in case of default and payment of the interest the whole debt at the option of said trust company should be treated as one and the mortgage foreclosed, the interest coupons to bear interest at the rate of 10% after maturity. Now in consideration of the agreement of the second party first to pay to said trust company upon the interest coupons held by them on the first days of February and August of each year, interest on the amount of this purchase at the rate of 7%, being the sum of __ per annum, and second upon the falling due of the mortgage aforesaid to pay to it upon the $5000 the above recited consideration of $__, the object of this sale and conveyance being to provide for the payment of principal and interest of said mortgage, and is made and accepted subject to all the provisions of said deed of mortgage of record in the office of the Bullitt County Court.

To have and to hold all of said land (excepting 1/4 of an acre thereon as the graveyard which the party of the first part reserves) with the improvements thereon unto the party of the second part, his heirs and assigns forever in fee simple with covenant of general warranty, and to evidence the obligations herein upon him the said party of the second part becomes a party subscribing hereto.

State of Kentucky, Bullitt County, Sct. I E. W. Hall, Clerk of the Bullitt County Court in the state of Kentucky, do certify that on the 1st day of February 1877 the foregoing deed from H. O. Maraman and wife to John H. Napper was produced to me in my county and acknowledged by H. O. Maraman and Elmira Maraman his wife and by John H. Napper, parties thereto to be their act and deed, and on the 15th day of March 1877 the same was lodged in my office and ordered to be recorded which with this certificate I have truly recorded in my office this 9th day of April 1877.
