James Halbert Heirs to William Congrove - Part of Two Shepherdsville Lots.

In this deed, dated 20 Aug 1825, Tax Collector H. F. Kalfus sold Shepherdsville lot 5 and 15 feet of lot 6 belonging to the heirs of James Halbert to William Congrove as shown below.

This indenture made and entered into this 20th day of August in the year of our Lord 1825 between Henry F. Kalfus, collector of the town tax of the town of Shepherdsville, and William Congrove, both of the county of Bullitt and state of Kentucky.

Witnesseth that whereas agreeably to an act of assembly of the Commonwealth of Kentucky approved February 9, 1808 concerning the town of Shepherdsville, the trustees appointed Henry F. Kalfus collector of the town tax for the said town for the year 1825; and whereas the said Henry F. Kalfus in pursuance of said appointment and agreeable to said act did regularly advertise according to law one lot No. 5 and also lot No. 6 in the new plan of the said town for sale for the purpose of raising the town tax and thereon and having advertised the said lots at the court house door and other public places in said town between ten and twenty days before the day appointed for the sale of the same, and in the aforesaid 20th day of August 1825 offer the said lots Nos. 5 & 6 for sale in market overt, and the said tax not being paid which the trustees of said town had by an order directed should be collected on said lots as town tax, the said Kalfus, collector as aforesaid, sold the same, and the said William Congrove became the purchaser of the aforesaidlot No. 6 (he being the highest bidder for the same for the sum of seventeen cents) and he also purchased 15 feet front of lot No. 5 as aforesaid for the sum of 17 cents, all which sums as aforesaid the said Congrove has to the said Kalfus in hand paid.

The lots Nos. 5 & 6 were both sold as the property of the heirs of James Halbert dec'd.

Now for and in consideration of the premises, the power vested in me by the appointment aforesaid as collector, and the sums of money aforesaid paid by said Congrove to me, I do hereby bargain sell, alien, release, convey and confirm unto the said Congrove the lot No. 6 and also the 15 feet front of lot No. 5 as aforesaid and all the appurtenances to each belonging.

To have and to hold the same to him and his heirs forever, hereby warranting and defending the said lot No. 6 and 15 feet front of lot No. 5 as aforesaid against the said heirs of James Halbert dec'd, and from all other persons so far as the power vested in me by the appointment as collector enables me so to do, and no further. In testimony whereof I have hereunto set my hand and affixed my seal the day and date above written. (signed) H. F. Kalfus, Collector of the town tax of Shepherdsville.
