Abraham Chappell & Others to James Arnold - 123 Acres

In 1843, a group of men, including Abraham Chappell, William F. Chappell, John W. Goheen, William Stibbins, James Arnold and Richard Skinner, purchased a half share (1000 acres) of Robert Sanford's 2000 acre patent from Nathaniel Pope who was living in Illinois at the time. We have not yet determined how Pope obtained this land.

According to the deed shown below, George W. Miles obtained John W. Goheen's share, and Abraham Chappell obtained William F. Chappell's share. Then in 1845, 123 acres of the tract was deeded to James Arnold by the others, as shown below.

Bullitt County Deed Book L, Pages 15-16

This indenture made and entered into this 16th day of May 1845 by and between Abraham Chappell, William Stibbins, George W. Miles and Richard Skinner of the county of Bullitt and state of Kentucky of the one part and James Arnold of the county and state aforesaid of the other part, and is as followeth. Whereas the said Chappell, Arnold, Stibbins and Skinner and one John W. Goheen and William F. Chappell purchased of Nathaniel Pope of the state of Illinois 1000 acres of land lying in the county of Bullitt on the waters of Salt River, the same bing the undivided half of Robert Sandford's 2000 acre survey; and whereas the said George W. Miles took the place and benefit of John W. Goheen and his purchase; and whereas the said Abraham Chappell took the place and benefit of William F. Chappell and his purchase; and whereas the said Arnold paid to the said Pope the full sum of $123 for 123 acres of land so purchased of the said Pope by the parties as aforesaid. Now this indenture witnesseth that for and in consideration of the said sum of $123 so paid by the said Arnold to the said Pope and the further consideration of the quit claim deed this day made by the said Arnold to the said Chappell, Skinner, Miles and Stibbins, hath granted, bargained, sold, conveyed and confirmed and by these presents doth grant, bargain, sell, convey, enfeoff and confirm to him the said Arnold, his heirs forever, all that part of said 1000 acres purchased as aforesaid and bounded as follows, to wit.

Beginning at a stone in Ballard Chappell's spring branch where the northern line of Jacob Myers' 1200 acres survey crosses the same and running thence down the branch N 18° W 23 poles to a stone in the Cedar Point Branch, thence N 16° E 285 poles to a dogwood and three hickories standing on both sides of a road, thence with the road N 71 1/2° W 13 poles to four sugar trees standing in the division line between the said Nathaniel Pope's 1000 acres and Sandford's 1000 acres, thence with said line S 37° W 278 poles to a white walnut, sugar tree and water beech on the side of a hill in a line of the original 2000 acre survey, thence with the same S 68 1/2° E 14 poles to a sugar tree and beech, one of the original corners, thence with another line S 40° E 115 poles to the intersection with the north line of Jacob Myers' survey aforesaid, and with the same N 54° E 26 poles to the beginning.

To him the said Arnold to have and to hold the said land to his only proper use and benefit with all and singular the appurtenance thereunto belonging, and the said Chappell, Stibbins, Miles and Skinner further covenants to and with the said Arnold that they will and their heirs shall forever warrant and defend the title to the said land against the claim of all and every person either claiming or to claim in, under by or through them the said Chappell, Stibbins, Miles and Skinner, but against the claim or claims of no other person or persons whatever. In testimony whereof we have hereunto set our hands and seals the day and year above written. I John W. Goheen and Rebecca his wife, and William F. Chappell and Eliza Ann his wife hereby join in this conveyance to its full extent and legal meaning. (signed by all parties)
