David L. Brooks to Preston Hornbeck - One Eighth of 408 Acres

Following the death of Samuel Hornbeck, his estate was divided among his eight heirs including his daughter Mary Brooks. Mary and her husband David L. Brooks sold their share of the 408 acre tract to her brother Preston N. Hornbeck on 20 Nov 1839 for a payment of $800.

This indenture made this 20th day of November 1839 between David L. Brooks and Mary his wife, late Mary Hornbeck, one of the children and heirs of Samuel Hornbeck, dec'd, of Bullitt County and state of Kentucky of the one part, and Preston N. Hornbeck of the county and state aforesaid of the other part. Witnesseth that the said Brooks and wife for and in consideration of the sum of $800 good and lawful money to them in hand paid, the receipt whereof is hereby acknowledged, they the said Brooks and wife have sold, and by these presents do sell and confirm unto the said Preston N. Hornbeck and to his heirs or assigns forever all their interest, right or claim of in and to a tract of land of 408 acres more or less in Bullitt County on the waters of Floyd's Fork, being one undivided eighth of said tract, being the same tract of land whereon his widow and some of his heirs now live, with its appurtenances.

To have and to hold the said undivided eighth part of said 408 acres more or less of land aforesaid unto him the said Preston N. Hornbeck and his heirs and assigns forever. And the said Brooks and wife hereby covenant and agree to and with the said Preston N. Hornbeck to warrant and forever defend the sai undivided eighth part of said 408 acres of land unto him the said Preston N. Hornbeck and his heirs forever against the claims of themselves and their heirs and all other persons by this their deed in fee simple with general warranty.
