John F. Crist to Casper Herps - November 1862

In November 1862, John F. and Jane Crist sold two tracts to Casper Herps. Both tracts lay along the road leading from Shepherdsville to Cane Spring. The first tract of 59.5 acres adjoined lands of George Weller, Mr. Shirley and Ben Newton. The second tract was 9.5 acres and adjoined the first tract at its northwest corner. It adjoined lands of James Deacon, John Bolton and Felix Harris.

This indenture made and entered into the 24th day of November 1862 between John F. Crist and Jane, his wife, of the county of Bullitt and state of Kentucky, parties of the first part, and Casper Herps of the county and state aforesaid, party of the second part. Witnesseth that the parties of the first part, for and in consideration of the sum of $1000 of which amount $550 in hand paid, the receipt whereof is hereby acknowledged, the balance or remainder of $450 the said Herps has this day executed his note payable on the 25th day December 1863, have granted, bargained, sold and by these presents do grant, bargain, sell and convey unto the said party of the second part, his heirs and assigns, two certain tracts of land, situated, lying and being in the county of Bullitt on the road leading from Shepherdsville to the the Cane Spring, and being the same two tracts of land said John F. Crist bought of his mother, Sophia Wethers, which are recorded in the Bullitt County Clerk's Office Book P, page 57, the tract of land on which the said Crist now lives is bounded as follows.

Beginning at a stone, corner to George Weller, thence with his line S 23° W 92 poles to a white oak, Weller's corner, thence with Weller's line N 66° W 23 poles, 14 links to a stone and dogwood, Weller's corner, thence with another of Weller's lines S 24° W 59 1/2 poles to an elm, Shirley's corner, thence with Shirley's line N 12 1/2° E 138 poles to a stake, Shirley's corner, in a line of land sold by Sophia Wethers to Ben Newton, thence with Newton's line S 55° E 7 poles to a large beech, Newton's corner, thence with another of his lines, N 39° E 55 poles to Newton's corner at the county road, thence with the road and James Deacon's line, S 45° E 29 1/2 poles, S 61° E 34 poles, S 71° E 22 poles to the beginning, containing 59 1/2 acres.

The other tract adjoining the above tract at the northwest corner lying on the north side of the road is bounded as follows. Beginning at a stake, corner to the above described tract of land, thence with James Deacon's line N 1 1/2° W 49 poles to a white oak, black oak and beech, Deacon's corner and original corner to Dowdall's 500 acre survey, thence with Deacon's line N 5° E 2 1/2 poles to a forked dogwood, Deacon's and John Bolton's corner, thence with Bolton's line N 24 1.2° W 45 poles to a stone, corner to Felix Harris, thence with Harris' line S 45° W 30 poles to a forked white oak near a spring at the county road, Harris' corner, thence with the road and a line of land sold by Sophia Wethers to Ben Newton S. 39° 50' E 20 poles, S 52 1/2° E 8 5/6 poles, S. 20° E 40 poles, S 41° E 12 1/2 poles to the beginning containing 9 1/2 acres.

To have and to hold the above described tracts of land with the appurtenances unto the said party of the second part, his heirs and assigns forever; and the said parties of the first part hereby covenant and agree that they will warrant and defend the title of the two above described tracts of land against themselves, their heirs, and all person or persons whatsoever. In witness whereof the said John F. Crist, together with Jane his wife who hereby relinquishes all her right of dower in and to the two tracts conveyed in this deed, have hereunto set their hands and seals the day and date above written.
