Bullitt County Deed Book K, Pages 282-284
This indenture made this 13th day of August in the year of our Lord 1844 between Charles Hall, Martha Relfe and Sally Relfe and Elizabeth Relfe, all of the county of Bullitt and state of Kentucky.
Witnesseth that whereas Thomas Relfe dec'd did in his lifetime purchase of one Henry Crist a tract of land lying on Salt River on the North side thereof below Clark's Ford, and the said Thomas Relfe departed this life before the said Crist made a conveyance of said land to said Thomas Relfe dec'd. The said Crist after the death of said Thomas Relfe conveyed it to the widow Elizabeth Relfe and the heirs of said Thomas Relfe the said tract of land containing 196 acres of land. The deed from Henry Crist to the widow and heirs of Thomas Relfe dec'd is of record in the clerk's office and the Bullitt County Court, to which reference is made for the courses and boundaries of said land.
The heirs and children of said Thomas Relfe dec'd are as follows to-wit: Elizabeth Relfe, widow of Thomas Relfe, Martha Relfe, John Relfe, Sally Relfe, Mary Relfe who has since married James Trent, and Louisa Relfe who has since married William Forrester.
And whereas Charles Hall has purchased the interest of three of the heirs of Thomas Relfe in and to said tract of land, to-wit, John Relfe, James Trent and Mary his wife, formerly Mary Relfe, William Forrester and Louisa his wife, formerly Louisa Relfe.
And whereas the said Charles Hall, Elizabeth Relfe, widow, and Martha Relfe and Sally Relfe have agreed on a division of said land between themselves; the said Elizabeth Relfe is to have her life estate in the following described piece of land, to-wit.
Beginning at two beech trees standing on the North bank of Salt River and running thence North 6° East 64 poles to a large popular tree, thence North 2° East 190 poles to 3 beech trees, thence South 72° West 30 poles to three beech trees, thence South 8 1/2° West 14 poles to a rock marked E.R. at the lane fence, thence South 6° West 41 poles to an elm and two sycamore trees on the bank of Salt River, thence up Salt River North 66° East 25 poles, thence North 88° East 26 poles to the beginning which the said Elizabeth Relfe agrees to accept as her dower in the said land so conveyed to the widow and heirs of Thomas Relfe by Henry Crist.
And the said Charles Hall and Martha Relfe and Sally Relfe on their parts convenant and agree to and with the said Elizabeth Relfe that they will respectively warrant and defend the title of the above described tract of land which contains 62 acres from themselves, their heirs, and from the claim of all persons claiming in through or by them unto the said Elizabeth Relfe, her heirs and assigns during her natural life; and the said Elizabeth Relfe on her part covenants and agrees to and with Charles Hall, Martha Relfe and Sally Relfe to relinquish all claim that she may or might have in and into the balance of said tract of 196 acres, and will warrant and defend the title of the same from herself and from all persons claiming in by or through her to the said Charles Hall, Martha Relfe and Sally Relfe, and their heirs forever.
And whereas Charles Hall, Martha Relfe and Salley Relfe have divided the balance of said tract of land between themselves, the said Charles Hall being entitled to three-fifths of said land, and the said Martha Relfe and Sally Relfe being entitled to one-fifth each in value.
The land allotted to Charles Hall contains 96 acres and layers within the following described bounds, to-wit. Beginning on Whittakers run at a corner of the land sold by Charles Hall to Nicholas Porter, thence with said land a north weirdly direction to Porter's corner in one of the original lines of the 196 acre survey, thence with the several lines of said survey to the beginning. The land allotted to Martha Relfe and Sally Relfe layers within the following described bounds, to-wit. Beginning at the corner of the tract of land sold by Charles Hall to Nicholas Porter on Whitaker's run in a line of Relfe's original survey of 196 acres, thence with sideline down Whitaker's run to Salt River, thence up Salt River to the lower corner of Elizabeth Relfe's lot of land, thence with her line and binding on the same until it intersect the line of the original survey, thence with the same binding thereon to Nicholas Porter's line, thence with the same and binding thereon to the beginning containing 38 acres more or less.
Now, therefore these presents witnesseth that for and in consideration of the above premises and for the purpose of making a division of the balance of said tract of 196 acres of land after deducting the widow's dower of 62 acres between the said Charles Hall and the said Martha Relfe and Sally Relfe, and for securing to the different parties their interest in and to the same, the said Charles Hall on his part covenants and agrees to and with the said Martha Relfe and Sally Relfe that he will and his heirs shall forever warrant and defend the said tract of land so allotted to Martha Relfe and Sally Relfe from himself, his heirs and from all persons claiming in throught or by them unto the said Martha Relfe and Sally Relfe and their heirs forever; and the said Martha Relfe and Sally Relfe on their parts covenant and agree to and with the said Charles Hall that they will and their heirs shall forever warrant and defend the title of the said tract of land so allotted to the said Charles Hall from themselves, their heirs, and from the claim of all persons claiming in through or by them unto the said Charles Hall and his heirs forever.
And whereas the dower right of Elizabeth Relfe, which at her death wil descend to the said Charles Hall and Martha Relfe and Sally Relfe, viz. three-fifths to Charles Hall and two-fifths to Martha Relfe and Sally Relfe has not been divided but still remains in common between the parties and for the true and faithful performance for the several contracting parties they have hereunto set their hands and affixed their seals the day and year above written.
