Benjamin Chapeze to James Masden, 304 Acres

In January 1823, Benjamin Chapeze purchased 1000 acres of land from the heirs of John Hunter that was located in southern Bullitt County and included the tract patented to Hunter on 1 Apr 1792. Then, on 11 Feb 1823, he sold 304 of those acres to James Masden, as shown in the deed and transcription below.

This indenture made and entered into this 11th day of February 1823 between Benjamin Chapeze and Elizabeth his wife of the county of Nelson and state of Kentucky of the one part and James Masden of the county of Bullitt and state aforesaid of the other part. Witnesseth the said Benjamin and Elizabeth Chapeze have this day bargained and sold to the said James Masden for and in consideration of the sum of five hundred and fifty dollars secured to be paid by notes with Jonathan Masden as his security, the receipt whereof is hereby acknowledge, a certain tract or parcel of land lying in the county of Bullitt on the Rolling Fork of Salt River, being part of a 1000 acre tract patented to John Hunter that Benjamin Chapeze bought of James Hunter, containing three hundred and four acres. Bounded as follows (to wit) Beginning at two hickories and sugar tree standing on the bank of Rolling Fork on the lower side of a gut, thence leaving the river W 30 E 148 poles to a hickory, dogwood and white oak, thence N 6 W __ poles to 2 white oaks, J. Hunter's corner on a line of Cuthbert Harrison's survey of his 5000 acre survey, thence with his line S 38 W 332 poles to 3 beech trees on the bank of the Rolling Fork and corner to said Harrison, thence up the river as it meanders to the beginning, to have and to hold the aforesaid tract or parcel of land to the use, benefit and behoof of the said James Masden, his heirs &c the said Benjamin & Elizabeth Chapeze for themselves, their heirs &c do hereby warrant and defend the aforesaid tract of land to the said Masden, his heirs &c forever from the claim of the said Benjamin & Elizabeth, and from all other claims whatever. It is agreed on and understood that should a suit be brought against the said Masden for the aforesaid land, that the said Benjamin Chapeze is bound to refund the consideration money without interest. In testimony whereof the said Benjamin Chapeze and Elizabeth Chapeze have hereunto set their hands and affixed their seals the date first written. (signed) Ben Chapeze, Elizabeth Chapeze

State of Kentucky & County of Nelson (to wit)
I Thomas T. Grayson, deputy clerk of the county court of said county, do certify that on the day of the date hereof Benjamin Chapeze & Elizabeth his wife, party to the above indenture, did in my presence acknowledge the same to be their act and deed, and I further certify that the said Elizabeth was examined by me privily and apart from her husband when she declared to me that she did freely and willingly seal and deliver the said indenture and wished not to retract. I the clerk of the county court of Bullitt County do certify that on the first day of March 1823 the above foregoing indenture of bargain and sale was produced to me in my office and being duly certified, I have recorded the same with the certificates thereon endorsed in my said office as required by law.
