Wilhite Carpenter - James B. English - 230 Acres

In February 1865, Wilhite Carpenter and his wife sold 230 acres of land to James B. English that lay south of Salt River and Shepherdsville. It included the land through which the railroad passed, and English took on the responsibility for maintaining the fence along the tracts. This deed is transcribed below.

This indenture made and entered into this 15th day of February 1865 by and between Wilhite Carpenter and Letitia A. his wife of the County of Bullitt and State of Kentucky of the first part, and James B. English of the county and state aforesaid of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of $4000 to him in hand paid, the receipt whereof is hereby acknowledged, has granted, bargained and sold, and by these presents does grant, bargain and sell unto the said party of the second part, his heirs and assigns, the following tract or boundary of land situate, lying and being in said county of Bullitt and on the waters of Salt River, and bounded as follows, to wit.

Beginning at an elm on the bank of Salt River, original corner between Wilhite Carpenter and F. Maraman, thence down Salt River N 88° W 10 poles to a stone on the bank of said river, thence S 38 1/2° W 160 poles to a stone, thence S 60°51' W 32 3/4 poles to a stone on the west side of a road, agreed corner between Carpenter and Moore, thence with the agreed division line between Carpenter and Moore S 71° (?) 171 1/2 poles to a stone, agreed division corner between Carpenter and Moore, thence with their division line N 55 2/3° E 132 poles to a stake in the Big Road, thence S 50 3/4° E 6 poles to a stake in branch on the Big Road leading to Bardstown, thence N 85° E 34 poles 11 links to a stake in same road, thence N 8 1/2° W 79 poles to Salt River, thence down the same with its meanders 183 poles to the beginning, and being the same land conveyed to the party of the first part by F., G.W. and H.O. Maraman, reference to their deeds of record will more fully show. The right of way over this land has already been given to the Louisville and Nashville Railroad by the said party of the first part, and an agreement made with said road that the said party of the first part should fence said road so far as the same now through the land herein conveyed , the said party of the second agrees to do the fencing of said road and relieve by doing said fencing the party of the first part from his agreement with the L&N Railroad; containing 230 acres, more or less. To have and to hold said land against the said party of the first part and all others by this deed of fee simple with general warranty.

State of Kentucky, County of Bullitt, Sct. I Charles R. Samuels, clerk of the county court of the county aforesaid, do hereby certify that the foregoing deed from Wilhite Carpenter and Letitia his wife to James B. English was on the 25th day of March 1865 produced to me in my county and acknowledged by the Letitia to be here act and deed. And on the 3rd day of January 1866 the same was acknowledged by the said Wilhite Carpenter to be his act and deed in my office. And the same being stamped as is required by the Act of Congress was ordered to be recorded, which together with this certificate I have truly entered of record in my said office this the 4th day of January 1866.
