John Bryant to Benjamin Summers - 500 Acres

On 31 Jan 1809, John and Mary Bryant sold 500 acres of the land formerly belonging to Thomas Owsley to Benjamin Summers. It was located in the region of Cedar Creek, a tributary of Floyd's Fork.

This indenture made the 31st of January in the year of our Lord 1809 between John Bryant and Mary Bryant his wife of the County of Garrard and Commonwealth of Kentucky of the one part and Benjamin Summers of the County of Bullitt and Commonwealth aforesaid of the other part. Witnesseth that the said John Bryant and Mary his wife for and in consideration of the sum of five shillings current of Kentucky to them in hand paid before the sealing and delivery hereof, the receipt whereof is hereby acknowledged, have given, granted, bargained, and sold, and by these presents do give, grant, bargain and sell, alien, release, convey and confirm unto the said Benjamin Summers, his heirs and assigns forever an undivided 500 acres part of an entry of 738 acres entered, surveyed and patented in the name of Thomas Owsley, lying and being in the County of Bullitt and bounded as follows, to wit.

Beginning at two beech trees and a poplar on the top of a ridge about 80 poles north of the great Buffalo Road leading from Bullitt's Lick to the head of Floyd's Fork and about six and a half miles from said Lick and 56 poles to the east of a large branch of Cedar Creek, running thence North 70° East 246 poles to a sugar tree, hickory and elm on the side of a ridge and about 30 poles from the Buffalo Road, thence North 20° West 480 poles to two white oaks and a poplar in a large briar flat, thence South 70° West 246 poles to a black oak, hickory and elm in a large flat, thence South 20° East 480 poles to the beginning, with its appurtenances and hereditaments, and which said undivided 500 acres were conveyed by deed not recorded to John Bryant and devised by the last will of said Owsley to Mary Bryant.

To have and to hold the said undivided tract or parcel of land with all the appurtenances thereunto belonging unto the said Benjamin Summers, his heirs and assigns to his and their only proper use, benefit and behoof forever. And the said John Bryant and Mary his wife covenant, promise, agree to and with the said Benjamin Summers, his heirs, executors, administrators and assigns for themselves, their heirs, executors and administrators that they will forever warrant and defend the said undivided tract or parcel of land, with all and singular the appurtenances unto the said Benjamin Summers, his heirs, executors, administrators and assigns against them the said John Bryant and Mary his wife, their heirs, executors and administrators against them the said John Bryant and Mary his wife, their heirs, executors and administrators, and the claim or claims of all and every person or persons whatsoever claiming by, through, from or under them, but not against the claim or claims of any other person or persons whatsoever. In witness whereof the said John Bryant and Mary his wife have hereunto set their hands and affixed their seals the day and year first above written. (signed) John Bryant, Mary Bryant
