James Brown to George W. Jenkins - Shepherdsville Lots 39-40 - Part 4

In 1826, via a Circuit Court decree, John W. Beckwith, Weir Tilford and William Jones as commissioners deeded to George W. Jenkins parts of two Shepherdsville lots (#39 & #40) from the estate of James Brown deceased. This was following a court suit brought by Elizabeth Griffin against the Brown estate.

The ground had actually been purchased at auction by James Graham who instructed the commissioners to issue the deed to Jenkins who later sold it to Henry I. Craycraft.

Whereas at a Circuit Court held for the Bullitt Circuit at the courthouse in Shepherdsville on the 27th days of February 1819, and interlocutory decree was entered on the name of Elizabeth Griffin against James Brown's heirs appointing Wier Tilford, John W. Beckwith and William Jones or any two of them to divide into parcels and sell two lots in the town of Shepherdsville known on the plan of said town by the number 39 and 40 in pursuance of which decree the said commissioners divided said lots into five lots and made a plat thereof and on the 10th day of April 1819 sold the same and John Graham purchased lot number four on said plat being 39 feet, 8 3/4 inches fronting Main Street and extending 198 feet, 11 inches back to School Alley. For the sum of $303 and made out and return their plat and report to said court at their September town 1819 which was at a subsequent term thereof confirmed and the commissioners were directed to make conveyance to the purchasers on the payment of the purchase money, all which will more fully appear by reference to the record and proceedings of the said suit.

And whereas since the proceedings aforesaid the said John Graham has sold his claim to the said lot number four on said plat to George W. Jenkins and has directed the commissioners to make the conveyance thereof to the said Jenkins. Now this indenture made this 20th day of June 1827 between Wier Tilford and William Jones, two of the commissioners aforesaid the said John W. Beckwith having departed this life of the one part and the said George W. Jenkins of the other part. Witnesseth that the said Wier Tilford and William Jones commissioners of aforesaid for and in consideration of the premises and the payment of the said $303 by the said John Graham to the trustees of the Bullitt Academy have and by these presents do grant, alien, release, enfeoffing(?) and confirm unto the said George W. Jenkins, his heirs &c the said lot number four on the said plat part of lots numbers 39 and 40 as aforesaid.

To have and to hold the said lot number four with all the appurtenances thereto belonging unto the said George W. Jenkins his heirs &c and to his and their only proper use, benefit and behoof forever from the claim or claims of all and every person or persons whatsoever. But without individual responsibility for the title. In testimony whereof the said Wier Tilford and William Jones commissioners as aforesaid hereto set their hands and seals on the day and year within written. [Signed by Tilford and Jones.]
