Charlotte G. Benthall to Samuel Neill - 137 Acres

Charlotte Benthall, as the trustee of Sarah Shepherd Benthall and Julia Monroe Neill, and Samuel Neill petitioned the county court to divide a tract of land between them. This is the part that was granted to Neill.

Whereas by an order of the Bullitt County Court made the 16th day of August 1852 by W. B. Holsclaw, James Combs and C. Clay Kalfus were appointed commissioners to divide a tract of land in Bullitt County between Samuel Neill and Charlotte G. Benthall, the said Charlotte being the trustee of Sarah Shepherd Benthall and Julia Monroe Neill and the said commissioners having been first duly sworn made partition of the said tract of land between the said Samuel Neill of the one part and the said Charlotte G. Benthall of the other trustee as aforesaid, and having made report to said court of said division and said report being approved by said court and ordered to record and the said commissioners having been appointed by said court to convey the said land according to the partition as shown by said report.

Now in consideration of the premises, this indenture made this 15th day of January 1853 between Charlotte G. Benthall, trustee as aforesaid by W. B. Holsclaw and James Combs, two of the commissioners aforesaid of the one part and Samuel Neill, of the other part.

Witnesseth that the said Charlotte G. Benthall by W. B. Holsclaw and James Combs, commissioners as aforesaid, hereby transfers, aliens and conveys to the said Samuel Neill all that portion of the tract of land aforesaid, bounded as follows.

Beginning at a stake in the county road leading from Bardstown to the Long Lick bridge and running South 35° West 5 poles to a stake, thence South 41 1/2° East 4 poles to the middle of Neill's spring branch seven links from a box elder by the side of Neill's spring, thence South 26° West 150 poles to a stake in a field, thence South 12 1/2° East 137 poles to a beech, hickory and hoop pole, thence North 84° East 49 poles to two beeches, thence North 70° East 40 poles to a gum and beech, thence North 11° West 65 poles to a hickory and sycamore, thence with Chapeze's line South 70° West 40 poles to a stone and two beeches and a gum, thence with Chapeze's line still North 15° East 183 poles to a rock on the south side of a branch, thence North 57 1/2° West 57 poles to the beginning containing by calculation 120 acres.

To have and to hold the said tract of land in the above boundary together with the appurtenances thereto belonging to the said Samuel Neill for and during the term of his natural life, andthe said Charlotte G. Benthall by William B. Holsclaw and James Combs, commissioners as aforesaid, hereby releases, transfers and conveys by quit claim to the said Samuel Neill for his natural life the land embraced in the boundary above set out and the commissioners aforesaid incur no personal responsibility hereby. In testimony whereof the said Charlotte G. Benthall by William B. Holsclaw and James Combs, commissioners as aforesaid, hereto set her hand and affixed her seal the date above.
