W. B. M. Brooks to William T. Morrow - 1892 Trustee Assignment

On 25 Oct 1892, W. B. M. Brooks assigned William T. Morrow as his trustee to sell his property to pay his debts.

This deeded of assignment made and entered into by in between W. B. M. Brooks, party of the first part, and W. T. Morrow, party of the second part, all of the county of Bullitt and state of Kentucky.

Witness that the party of the first part does hereby convey, transfer and assign to W. T. Morrow, assignee and trustee, all of his property, real, personal and mixed whether in possession or in action, in trust for the benefit of all the creditors of the said W. B. M. Brooks, party of the first part according to law.

Said party of the first part is the owner of about 780 acres of real estate situated in Bullitt County Kentucky near Brooks station, lying upon the east and west side of the Louisville and Nashville Railroad, now occupied and cultivated by the said first party and a considerable amount of personal property, consisting of horses, cattle, hogs, sheep, and farming implements, which is also situated upon the land; which property together with all other property, real personal and mixed belonging to the said first party is hereby conveyed to the second party, assignee, and trustee as aforesaid.

To have and to hold unto said party of the second part, assignee and trustee, upon trust that he will sell and dispose of said property, and convey the same to the purchaser or purchasers, according to law, and that he will collect all debts and demands due the said first party and apply the proceeds of the sale of said property and the money collected by him upon the debts due the said first party in payment of the claims of the creditors of the said first party so far as the same will suffice in proportion to the amounts of their respective debts, and according to law, after paying the reasonable expenses of said trustee in the execution of said trust, and a just compensation for his services.

The party of the first part hereby expressly reserves unto himself such property as is by the laws of this Commonwealth set apart to bona fide housekeepers with a family, and exempt from execution and attachment.

The party of the second part joins herein for the purpose of accepting said trust. In witness whereof said parties of the first part and second part have here unto set their hands this the 25th day of October 1892. (signed) W. B. M. Brooks, W. T. Morrow
