When the owners of the southern part of Shepherdsville lot #57, namely Charles Jones' heirs, John Beckwith's heirs, Richard P. Simmons and Thomas W. Riley, refused to pay their share of the cost of paving next to their property, it was seized for payment, and purchased at auction by Thomas Shain, as described below. Shain received his deed to the lower 50 feet of the lot on 7 Jun 1840.

Whereas the trustees of the town of Shepherdsville under and by virtue of an act of the General Assembly of the Commonwealth of Kentucky directed that Main Street in said town from the public ground to Water Street should be McAdamized, and that the owners of the lots and parts of lots fronting said street should pay the expenses thereof, and on a failure thereof after the work should be done that said lots and parts of lots or so much thereof as should be sufficient should be sold by the town collector to satisfy and pay the costs of grading and McAdamizing the said street, and all costs for advertising and selling the same which work was let out to the lowest bidder and Thomas Shain became the undertaker.
And whereas also a part of lot number 57 claimed by Charles Jones' heirs, John Beckwith's heirs, Richard P. Simmons and Thomas W. Riley was subject to the payment of the costs and charges for grading and McAdamizing said street in front thereof as apportioned by the said trustees; and the said Charles Jones' heirs, John Beckwith's heirs, Richard P. Simmons and Thomas W. Riley failing and refusing to pay the amount levied and appropriated by said trustees on said part of said lot, William B. Holsclaw the collector of the said town was directed to advertise and sell said part of said lot or so much thereof as would be sufficient to pay and satisfy the amount so levied and apportioned and all costs attending the same.
In pursuance of the said order of said trustees and the said act of assembly the said William B. Holsclaw, collector as aforesaid, did after advertising as the law directed on the sixth day of April 1835 at the court house door in Shepherdsville (the Circuit Court for the Bullitt County being then in session) publicly offer said part of said lot hereafter in this deed described for sale and did then and there sell the same, and Thomas Shain became the purchaser for the sum of $93.36 and costs of sale besides.
This indenture therefore made this 17th day of June 1840 between the said William B. Holsclaw collector as aforesaid of the one part, and the said Thomas Shain of the other part.
Witnesseth that the said William B. Holsclaw collector as aforesaid for and in consideration of the law, the orders of said trustees, the sale aforesaid and the power vested in him by law hath and by these presents doth grant, alien, release, convey and confirm unto the said Thomas Shain that part of said lot number 57 which is contained in the following boundary, to wit.
Beginning at the southwest corner of said lot on Main Street, thence with the line of Main Street northwestwardly fifty feet to a stake, thence eastwardly parallel with Water Street to a stake in the back line of said lot adjoining Nicholas Simmons' lot, thence southwardly to the southwest line of Nicholas Simmons' house on Water Street, being 50 feet, thence with the line of Water Street the whole length of said lot to the beginning.
To have and to hold all the interest, right, title and claim of the said Charles Jones' heirs John Beckwith's heirs, Richard P. Simmons and Thomas W. Riley of in and to the said described part of said lot No. 57 with all the appurtenances thereto belonging unto him the said Thomas Shain, his heirs, executors and assigns, and to his and their only proper use, benefit and behoof forever, the said William B. Holsclaw collector as aforesaid hereby only warranting and defending the said described part of said lot to the said Thomas Shain, his heirs, executors and assigns as far as by law and his office he is bound to warrant and defend and no further, and without any responsibility on him or his heirs for the title. In testimony whereof the said William B. Holsclaw, collector as aforesaid, hereto sets his hand and seal on he day and year within written. (signed by Holsclaw)
