Susan J. Anderson - 1878 Last Will & Testament

Susan J. Anderson, daughter of John Anderson, was living in Jefferson County when she made the following will. In it she devised her estate to her niece and nephew, children of her sister Ann Anderson Shane.

I Susan J. Anderson, of the county of Jefferson, state of Kentucky, do hereby make, publish and declare this to be my last will and testament, revoking all others heretofore made by me.

To my nephew, Phillip L. Shane, I devise and bequeath 1/2 of my estate after the payment of my just debts, but subject to the provisions hereinafter named.

To my niece, Susan Belle Shane I devise in bequeath 1/2 of my estate after the payment of my just debts, but subject to the provisions hereinafter named; but the sum coming to said Susan Belle Shane I direct to be held in trust for her sold and separate use, free from the control of any husband she may have, and in case said Susan Belle Shane die without issue of her body, the portion coming to her under this will shall go at her death to said Phillip L. Shane.

Should said Phillip L. Shane die before coming of age, the portion bequeath and devised to him herein shall go to said Susan Belle Shane to be held in trust as before provided with power then to said Susan Belle to dispose of the same his will anyway she may desire.

For the long and faithful services of Emiline Brashear I wish to make some return, and I therefore direct said Phillip L. and Susan B. Shane to provide for her so long as she may live, and in case circumstances may arise under which they do not desire to have her with them, I direct that she be paid $100 per annum during her life from my estate.

It is my wish that said Phillip and Susan Belle Shane live together as long as possible, and keep Emiline Brashear with them. I direct my executors to take no account of my furniture or household goods, and to make no sale or disposition thereof, but they are to be for the use of said Phillip L. and Susan B. Shane and in case they separate, they will divide said furniture and household goods equally between them in kind.

I hereby appoint W. T. Morrow and Bennett H. Young the executors of this my last will and testament. Witness my hand this 27th day of April 1878. (signed) S. J. Anderson
