Samuel Hornbeck Land Division - Part 2 to Isaac Hornbeck

Following Samuel Hornbeck's death, his descendants divided his estate amongst themselves. The deed shown below describes this process, and identifies the part that went to his son Isaac Hornbeck.

Whereas Samuel Hornbeck deceased died owning a tract of 408 acres of land, more or less, on the waters of Floyd's Fork in Bullitt County, and left the following children and heirs at his death, viz. Solomon Hornbeck, John C. Hornbeck Isaac Hornbeck, Ruanne who married John Anderson, Susan who married Alfred Quick, Mary who married David L. Brooks, Dorthy who married James W. Knight and Preston N. Hornbeck and Susan Hornbeck his widow; and since the death of the said Samuel Hornbeck, the said Isaac and John C. Hornbeck purchased the interest of and received deeds of conveyance from the said Quick and wife, Anderson and wife and Solomon Hornbeck which together with their own shares made them the said Isaac and John C. Hornbeck owners of five undivided eighths of the said 408 acres of land. And said Preston N. Hornbeck has purchased and received deeds of conveyance from David L. Brooks and wife, and James W. Knight and wife which with his own share made him the owner of three-eighths of said 408 acres of land, and all said interest held subject to the dower of said Susan Hornbeck, the widow. And Isaac, John C. and Preston N. Hornbeck, purchased the dower interest os said widow and have received her deed therefore. And they the said Isaac, John C. and Preston N. Hornbeck have agreed to and actually divide said tract of 408 acres of land between them according to their said respective interests aforesaid, taking into consideration quantity and quality, whereby there has been set apart to said Isaac Hornbeck by metes and bounds as his full share in right of his purchases from said Anderson and wife, Quick and wife, Solomon Hornbeck and his own share the full quantity of 153 acres which are bounded as follows.

Beginning at John C. Hornbeck's corner in the lane between Hornbeck and Summers, thence North 88° West 174 poles to a stone marked I.A. and on the east bank of Brooks' Run, thence South 24° East (for 24 3/4°) 56 poles to a fallen white oak, red oak and black walnut near a cliff of rock and cave on Brooks' Run, thence South 4 1/2° West (for 2°) 30 poles to a stone, thence South 25° East (for 27 1/2°) 18 poles to a stone, thence South 9° West (for 8°) 31 poles to __ and black oak and hickory, thence South 10° East 24 poles to two sycamores on he bank of Brooks' Run and near John Anderson's gate, thence North 85°45' East 147 poles to a stake the southeast corner of J. C. Hornbeck's tract, thence with his line North 1/2° East 133 poles to the beginning.

And in like manner 140 acres were allotted to Preston N. Hornbeck, and in like manner to John C. Hornbeck 115 acres. And by agreement of the parties said Isaac, John C. and Preston N. Hornbeck, in consideration of the said purchase thus made, the said interests held under said purchases and the division so as aforesaid made, deeds of release by quit claim were to pass between said Preston N., John C. and Isaac Hornbeck and wives to equate them to place the legal title to said lots of land so divided to each one to whom the same was allotted. Wherefore in consideration of the whole premises and the agreements aforesaid,this indenture made this 22nd day of November 1839 between said Preston N. Hornbeck and Mary his wife, John C. Hornbeck and Delia W. his wife of Bullitt County and State of Kentucky of one part and said Isaac Hornbeck of same place of the other part, witnesseth that said Preston N. and John C. Hornbeck and wives in consideration of the premises aforesaid and the sum of one dollar each to them in hand paid, have sold and conveyed, and by these presents do release, convey and confirm unto him the said Isaac Hornbeck and to his heirs or assigns forever all the interests, right, title or claim which they said Preston N. Hornbeck and wife and John C. Hornbeck and wife have of in and to the said 153 acres more or less of land metes and bounded as herein before st forth, together with the appurtenances to the same belonging or in any wise appertaining. To have and to hold the said 153 acres of land as aforesaid unto to him the said Isaac Hornbeck and to his heirs forever against the claims of them the said Preston N. Hornbeck and wife and John C. Hornbeck and wife and all persons claiming by, from, through or under them or either of them by this their deed of release and quit claim. Witness the hands and seals of grantors. (signed) John C. State of Kentucky, Bullitt County Sct.
I Noah C. Summers, clerk of the county court for the county aforesaid, certify that the deed from John C. Hornbeck and wife and Preston N. Hornbeck and wife to Isaac Hornbeck was on the 2nd day of December 1839 produced to me in my office and acknowledged by the said John C. and Preston N. Hornbeck to be their act and deed. And the said Delia Hornbeck and Mary Jane Hornbeck, wives of the said grantors, being examined by me separately and apart from their said husbands, as the law requires, declared taht they did freely and willingly sign, seal and deliver said deed, and wished not to retract it, and again acknowledged said deed read and explained to them to be their voluntary act and consented that the said deed should be recorded. Whereupon said deed together with this certificate are truly recorded this 12th day of February 1840 in my said office. Att. Noah C. Summers C.B.C.C.
