Rufus K. Summers to Thomas Shain - Parts of Shepherdsville Lots 23-24

Bullitt County Deed Book I, Pages 90-91

This indenture made an entered into this 26 day of January and the year of our Lord, 1838 between Rufus K. Summers, and Sidna Ann his wife of the one part, and Thomas Shain of the second part, and all of the parties of the first and second part of the county of Bullitt and state of Kentucky. Witnesseth that the said R. K. Summers and wife for and in consideration of the sum of $354 paid and to be paid as follows and which when paid will be in full payment for the above consideration: $150 in hand and his note for $100 payable 18th of December 1838 with interest from the date; one note for $100 due and payable 18th of December 1839 with interest at 6% from the date, have granted, bargained, and sold to said Shain two parts of lots being parts of lots number 23 and 24 in the new plan of the town of Shepherdsville and the same on which my cabinet shop now stands, and adjoining to the tavern house of Robert F. Samuels, being 59 feet front on Main Street and 120 feet back to the stable of said Robert F. Samuels, more or less. The said R. K. Summers and wife do covenant and agree with the said Thomas Shain his heirs and assigns that they the said Summers and wife will warrant and forever defend the said two parts of lots number 23 and 24 against the claims of themselves and all persons claiming or to claim the same in, through or by them and against all other persons whatever.

The said R. K. Summers and wife also sell and convey to said Thomas Shain lot number 16 in the new plan of said town of Shepherdsville for and in consideration of the sum of $4 in hand, the receipt whereof is hereby acknowledged. It is expressly understood that they the said Summers and wife sell their claim to the said lot number 16, but do not defend against the claims of any other persons whatever.

In testimony whereof they the said Rufus K. Summers and Sidna Ann his wife affix their hands and seals the day and date above written. (signed) Rufus K. Summers, Sidna A. Summers.

State of Kentucky, Bullit County Sct. I Hezekiah W. Edwards, deputy for Noah C. Summers, clerk of the County Court for said county, do certified that this deed from Rufus, K. Summers and Sidna A. his wife to Thomas Shain was this 19th day of March 1838 produced to me and acknowledged by the said, Rufus K. Summers to be his act and deed; and the said Sidna A. being examined by me, privily apart from her husband, declared that she did freely and willingly sell and deliver the said writing, and wish not to retract it and acknowledged the said writing again shown and explained to here to be here act and deed and consented that the same may be recorded. Whereupon said deed and this certificate are truly recorded in said County Court office. Att. H. W. Edwards, D.C.
