John & Frances Pope to John H. Baker & Thomas Joyce, 1836

On 1 Jun 1836, John and Frances Pope conveyed to John H. Baker and Thomas Joyce what was then known as the Dry Lick tract along with the iron works on the land occupied by Baker. However, for reasons not apparent in the deed, Baker and Joyce did not accept it, and requested it not be recorded in the clerk's office.

Then, on 29 July 1848, Charles Quirey, agent for the Shepherdsville Iron Manufacturing Company, which by then owned the land, required that this deed be recorded.

This indenture made this first day of June in the year 1836 between John Pope and Frances of Washington County and State of Kentucky of the one part and John H. Baker and Thomas Joyce of Bullitt County and state aforesaid of the other part.

Witnesseth that the said John Pope and wife, the party of the first part, for and in consideration of the sum of $6000 to them in hand paid by the said Baker and Joyce, the party of the second part, hath granted, bargained and sold, and by these presents doth grant and sell to the said Baker and Joyce as tenants in common all that tract or parcel of land situate in the said county of Bullitt including the salt wells and furnaces owned and occupied formerly by said Pope and wife with the iron works occupies by said Baker with all the land and appurtenances of the tract of land commonly called the Lick Tract or Dry Lick Tract which wsa owned by the said Pope and wife at the time of the contract of sale to said Baker and Joyce by John W. Cocke, agent for said Pope - the tract contained originally between seven and eight thousand acres.

To have and to hold the said tract or parcel of land with all and singular the appurtenances supposed to contain between seven and eight thousand acres be the same more or less - to the said Baker and Joyce as tenants in common and to their heirs and assigns respectively, to the only use and benefit of the said Baker and Joyce and their heirs and assigns respectively forever and the said John Pope and Frances his wife, devisee of Matthew Walton dec'd, covenant and agree with the said Baker and Joyce respectively and with their respective heirs and assigns that they said Pope and Fances his wife and their heirs and legal representatives will forever warrant and defend the said tract of land with all and singular the appurtenances hereby conveyed and intended to be conveyed against the claim or claims of all and every person or persons whatever. Whereas I John W. Cocke have a lien on the land contained in this deed, by deed of mortgage from John Pope to me of record in the Bullitt County Court office &c - so far as said mortgage covers and conveys the within land I do by these presents release all my claim to the within lands to the said Joyce and Baker, retaining only my lien for the amount of the purchase money due on the purchase by said Pope and Baker for the within land. Bullitt County I Noah C. Summers, Clerk of the county court for said count, certify that this deed from John Pope and wife to John H. Baker and Thomas Joyce with the certificate of acknowledgement thereon endorsed was the 11th of October 1836 produced to me in my office by the grantor Pope for record - On the 25th of November 1836 John W. Cocke appeared in my office before me and made, sealed, signed and acknowledged the release hereto annexed, of said date to be his act and deed, and the same was certified for record - but the grantees Baker and Joyce not accepting the deed - I did not at their request record said deed for that reason. State of Kentucky, Bullitt county I Noah C. Summers, clerk of the county court for said county, certify that on the 29 July 1848, Charles Quirey, agent for the Shepherdsville Iron Manufacturing Company, who claim to own by purchase and deed John H. Baker's interest and title to the land conveyed by the deed, came into this office and required this deed to be recorded, and the same being fully acknowledged, I have at the instance of said Quirey truly recorded this deed and the certificates of acknowledgement thereon endorsed, and this, in my said office, this 31st of July 1848.
