Nathan Miles to William W. Simmons - 243 Acres + Part of Shepherdsville Lot 41

This complicated and detailed deed involving court suits in which the Bank of the Commonwealth of Kentucky is the plaintiff with various defendants essentially transfers the ownership of a tract of 243 acres in Bullitt County where Nathan Miles lived, and also a house and lot in Shepherdsville that he owned from him to William W. Simmons. The location of the land tract is said to be described in Deed Book C, page 196; and that of the house and lot in Shepherdsville in Deed Book E, page 313. From this we ascertain that the town lot was a part of Lot #41 in the town's new plan.

This indenture made and entered into the second day of June in the year of our Lord 1827 between William Caldwell, deputy sheriff for Clifton Hall, sheriff of Bullitt County, of the one part and William W. Simmons of the county aforesaid of the other part.

Witnesseth that whereas on the 18th day of September in the year of our Lord 1826 there issued from the clerk's office of the Bullitt circuit court an execution commonly called a fifa numbered 2517 in the name of the Bank of the Commonwealth of Kentucky against the estate of John Myers, Nathan Miles, Sydney S. Alexander and Fred W. G. Alexander for the sum of $180 debt and 72.5 cents costs endorsed that it might be discharged by the payment of $93 and 18.75 cents with interest and costs and to be discharged by the payment of notes of the Bank of the Commonwealth of Kentucky or its branches which execution was directed to the sheriff of Bullitt County and which came to hand before the return day thereof, to-wit on the 19th day of September 1826, upon which the said deputy sheriff made the following return.

By virtue of the within execution I levied on the tract of land on which Nathan Miles lives, containing about 243 acres; also the interest of Sydney S. Alexander in the house and lot in Shepherdsville on which Thomas Q. Willson lives which has not been sold for want of time. William Caldwell, deputy sheriff for C. Hall, Sheriff of Bullitt County.

And whereas also on the 18th day of September 1826 there issued from the clerk's office of the Bullitt Circuit Court one other execution commonly called Fifa No. 2518 in the name of the said bank against the estates of Eben Younger, James Holmes, Nathan Miles and William J. Robards directed to the sheriff of Bullitt County for the sum of $250 and 70.5 cents costs endorsed to be discharged by the payment of $125.25 with interest at 6% from the 15th March 1826 until paid and cost, and for bank notes as before recited, and which came to the hand of the said deputy before the return day thereof, to-wit on the 19th September 1826, and upon which the said deputy made the following return, to-wit.

By virtue of the within execution, I levied on the tract of land on which Nathan Miles lives containing about 243 acres, which has not been sold for one of time. William Caldwell, deputy sheriff for Clifton Hall, sheriff of Bullitt County.

And whereas afterwards to-wit on the 9th day of April in the year 1827 there issued again from teh said clerk's office an execution commonly called a venditioni exponas number 113 in the name of the said Bank directed to the sheriff aforesaid directing him to expose to sale the said 245 acres of land and the said house and lot before spoken of to the amount of the said execution against the said John Myers, Nathan Miles, Sydney S. Alexander and F. W. G. Alexander as before recited, which execution came to the hands of the said deputy sheriff before the return day thereof, to-wit, on the __ day of May 1827; and whereas also their issued from the clerks office of the said court on the ninth day of April 1827 another execution commonly called a venditioni exponas number 114 commanding the sheriff of Bullitt County to expose to sale the estate of Eben Younger, James Holmes, Nathan Miles and William J. Robards, consisting of the said 243 acres of land on which Nathan Miles lived to the amount of the said $250 to be paid by $124.25 and interest as before recited, and $2.11 1/2 cost which came to the hands of the said deputy before the return day thereof, to-wit, on the __ day of May 1827, and which two last named executions were endorsed that the notes on the Bank of the Commonwealth of Kentucky would be received in discharge of the said debts and costs on which execution No. 113 the said deputy sheriff made the following return.

By virtue of this execution and one other vend exponas from the same office , number 114, I sold the land within mentioned on the premises the 5th day of May 1827, after having advertised according to law, and William W. Simmons became the purchaser for the amount of the executions, being $216.29 less debt interest, costs and commissions, the sale was made for Commonwealth's money in hand the amounts of this execution is $100.65, being paid by the purchaser, which I am ready to render. William Caldwell, deputy sheriff for C. Hall, sheriff of Bullitt County.

And on the said execution No. 114 the following return, by virtue of this execution and one other No. 113 from the same office, I sold the land within mentioned in the premises the 5th day of May 1827 after having advertised according to law, and William W. Simmons became the purchaser for the amount of the execution, being $246.79 debt interest, costs and commissions, the sale was made for Commonwealth money in hand, the amount of this execution is $133.85 of which was paid by purchaser and which I am ready to render. William Caldwell, deputy sheriff for C. Hall, sheriff of Bullitt County.

And whereas also on the 10th day of August 1826 there issued from the clerk's office of the Bullitt Circuit Court execution 12360, commonly called a Fifa in the name of Richard P. Simmons and Sons against the estate of Nathan Miles and William Jones for the sum of $350 debt and 70.5 cents cost directed to the sheriff of Bullitt County and endorsed to be discharged by the payment of $147.43 1/2 with interest at 6% from the 4th day of August 1826 until paid and the cost aforesaid, and also that it might be discharged by the payment of notes on the Bank of the Commonwealth of Kentucky or its branches, which execution came to the hands of the said deputy sheriff before the return day thereof, to-wit, on the 10th day of August 1826, adn upon which he made teh following return, to-wit.

By virtue of the written execution and agreeably to the directions of Nathan Miles, I levied on the house and lot on which James Holmes lives, situate in Shepherdsville between Matthew Wilson's store and Barker's grocery which has not been sold for want of time. William Caldwell, deputy sheriff for C. Hall, sheriff of Bullitt County.

And whereas afterward, to-wit, on the 9th day of April in the year 1827 there issued from the clerk's office of the said Bullitt Circuit Court an execution No. 117, commonly called a venditioni exponas in the name of the said Simmons and Sons against said Miles and Jones directed to the sheriff of Bullitt County, directing him to sell the said house and lot to satisfy and pay the debt and cost on the said last execution named, and which came to the hands of the said deputy sheriff before the return day thereof, to-wit, the __ day of May 1827, and upon which the said deputy sheriff made the following return, to-wit.

By virtue of the within execution and agreeably to advertisements, I sold on the fifth day of May 1827 all the right, title, claim and interest of Nathan Miles in and to the lot within mentioned. William W. Simmons purchased for the sum of $92.25 cost Commonwealth money, which is the balance in full due on this execution including sheriff's commission, the purchase money was paid to me and which I have paid to plaintiff, and the said William Caldwell, deputy sheriff as aforesaid, having advertised the said tract of land and the said houses and lots for sale in all respects according to law, and having on the fifth day of May 1827 upon the premises of the said tract of land at the house where Nathan Miles lived and upon the premises on the said lot in Shepherdsville where James Holmes lived between the hours of 11:00 A.M. and 3:00 P.M. offered the same for sale to the highest bidder for ready money in Commonwealth Bank notes, the said William W. Simmons being the highest bidder became the purchaser of the said tract of land and last named house and lot for the sums expressed in the returns of the said deputy sheriff as above recited.

Now, for an in consideration of the premises and the payment of the said sums of money by the said Simmons to the said deputy sheriff in hand, the said William Caldwell, deputy sheriff as aforesaid, doth by these presents sell and convey unto the said Simmons, all the right, title and interest of the said Nathan Miles of, in and to the said tract of land lying in Bullitt County and bounded as follows, to-wit. Beginning &c, see Deed Book C, page 196 for the courses, being a deed for the same from Nathan Miles Sr. to the said Nathan Miles for the tract of land aforesaid recorded in the clerk's office of the Bullitt County Court in book before referred to the same lot being the same conveyed by deed from E. K. Willson, deputy sheriff for Jesse Willson, sheriff of Bullitt County, to the said Nathan Miles, recorded in the clerk's office of the Bullitt County Court, Deed Book E, page 313.

To have and to hold the said tract of land and house and lot to him the said Simmons, his heirs &c against the claim of the said Miles, his heirs &c, the said sheriff, not being responsible further than by virtue of his office the law would bind him. In testimony whereof the said William Caldwell, deputy sheriff for Clifton Hall, sheriff of Bullitt County, hath hereunto set his hand and affixed his seal the day and date above written.
