H. F. Kalfus, Tax Collector to Noah C. Summers - Multiple Shepherdsville Lots

In 1825, Henry F. Kalfus, tax collector for Shepherdsville, sold several town lots for their tax bills. Sydney S. Alexander was the purchaser of almost all of the lots, but had Kalfus issue the deeds to Noah C. Summers, as shown below. The lots included 26, 41, 42, 47 and 63.

This indenture made this 31st day of October in the year of our Lord 1825 between Henry F. Kalfus, collector of the town tax for the town of Shepherdsville, county of Bullitt and Commonwealth of Kentucky of the one part and Noah C. Summers of the town, county and Commonwealth aforesaid of the other part.

Witnesseth that whereas the trustees of the said town of Shepherdsville did by virtue of the power vested in them by law, and in pursuance of an act of the general assembly of the Commonwealth of Kentucky concerning the town of Shepherdsville passed the 19th February 1808 levy a tax on the inhabitants of said town of Shepherdsville, and also regularly appoint the said Henry F. Kalfus the collector thereof for the year 1825; and whereas the said Henry F. Kalfus, collector as aforesaid, did in pursuance of said appointment and in accordance with the law aforesaid, in such case made and provided, regularly advertise certain lots in said town for sale for the payment of the tax, and therein for the year aforesaid, and the said Kalfus, collector as aforesaid, after having in all things pursued the law and in pursuance of said notice and law regularly expose to public sale to the highes bidder in market avert on the 20 day of August 1825, being the day appointed by him by his notice and advertisement as aforesaid certain lots and improvements thereon.

And said town when Sydney S. Alexander being the hightest bidder became the purchaser of a whole lot numbered 26 in the new plan in said town of Shepherdsville at the price and for the sum of one dollar, that being the amount of taxes levied and due on said lot for the year 1825, which said lot of ground and improvements thereon was late the property of James Brown dec'd, and then in possession of lated claimed by James Alexander, the said collector just advertising and offering a part thereof, and no person bidding, the whole amount was sold as aforesaid for the payment of the tax due thereon as aforesaid.

And the said Alexander in like manner as aforesaid became the purchaser of lot No. 41 in the new plan of said town as aforesaid as was not heretofore sold and conveyed to M. & S. Wilson at the price and for the sum of 75 cents, being the amount of tax levied and thereon for the year aforesaid, the same now in possession of James Alexander and claimed by said Alexander, Benjamin Summers, Armstead Morehead, the heirs of Richard Prather dec'd & others.

And the said Alexander in like manner as aforesaid became the purchaser of Lot No. 42 in the new plan of said town at the price and for the sum of 75 cents, being the amount of tax and thereon as aforesaid the said last mentioned lot being sold in two parcels, a part claimed by the heirs of John Lemasters dec'd and a part by James Alexander and others, all of which is in the possession of said James Alexander.

And the said Alexander in like manner became the purchaser of lot number 47 in the new plan of said town for the sum of 25 cents, that being the amount of tax due thereon as aforesaid, the same in the possession of James Alexander and claimed by him and others.

And the said Alexander in like manner became the purchaser of lot number 63 in the new plan of said town for the sum of 50 cents, that being the amount of tax due thereon as aforesaid, the same claimed by the heirs of James Prior dec'd.

And also the said Alexander became in like manner aforesaid the purchaser of lot number 64 in the new plan aforesaid sum at the price of 20 cents, that being the amount of tax due thereon as aforesaid, the same claimed by the said heirs of James Prior dec'd.

And whereas the said Sidney S. Alexander since the sale and purchases aforesaid having regularly sold and transferred the said lots and improvements thereon so as aforesaid purchased to the said Noah C. Summers for a valuable consideration confessed and passed. And he having by his certificate directed me to convey the same to the said Summers which said certificate and sale of transfer is in these words: "For a valuable consideration this day received by me of Noah C. Summers in the sale of certain lots of ground and improvements thereon in the town of Shepherdsville purchased by me of Henry F. Kalfus, town collector, I do hereby sell and assign to him the said Noah C. Summers the full benefit of my purchase made as aforesaid .. I do hereby direct and authorize the said Kalfus, collector as aforesaid, to convey the same to the said Noah C. Summers in lieu of my self. Given under my hand this 25th day of August 1825. I do by these presents in consideration of the premises and the certificate of sale and transfer as aforesaid and the further consideration of the power in me vested by law and also one dollar current money to me in hand paid by said Summers as well as the receipt of the taxes due for the lots sold as aforesaid, sell, alien, transfer and convey unto him he said Noah C. Summers, his heirs and assigns forever the said lots of land and premises aforesaid described and numbered. And the said Henry F. Kalfus, collector as aforesaid, by virtue of the power vested in him as collector and as fully as by law he is authorized, does hereby ratify and confirm the sales of said lots of land and improvements thereon unto him the said Noah C. Summers, his heirs, executors, administrators and assigns forever, warranting the same as fully as by law he is authorized.

And it is especially understood and the true intent and meaning of the said intention of sale and conveyance is that the said Kalfus, collector as aforesaid, only sells and conveys to him the said Noah C. Summers and to his heirs all the right, title, claim and interest of all and every person or persons whatsoever to the same belonging or in any wise appertaining as collector as aforesaid, and is not in any event whatever to be made in any manner responsible or answerable for the title thereto in his individual capacity.

In witness whereof the said Kalfus, collector as aforesaid, and the said Sydney S. Alexander, the first purchaser thereof of said lots have hereunto set their hands and seals. (signed) Henry F. Kalfus, Sydney S. Alexander
