Henry C. Jones to Francis Maraman - 2 Tracts

This deed, written on 20 Dec 1834, transferred 2 tracts of land on the south side of Salt River near Shepherdsville from Henry C. Jones to Francis Maraman. One tract was part of Shepherd's 600 acre survey; the other was part of James Brend's 977 acre survey.

This indenture made this 20th day of December 1834 between Henry C. Jones and Ellender, his wife of the county of Bullitt and state of Kentucky of the one part, and Francis Maraman of the same county and state of the other part. Witnesseth that the said Henry C. Jones and Ellender, his wife for and in consideration of the sum of $304.50 to them in hand paid before the sealing and delivery hereof, the receipt whereof hereby acknowledged, have granted, bargained, and sold, and by these presents do grant, bargain and sell, alien, release, convey and confirm unto the said, Frances Maraman a certain tract or parcel of land situate lying and being in the said county of Bullitt on the south side of Salt River containing forty acres, part of Shepherd's 600 acre survey, and bounded as follows, to wit.

Beginning at a stone in the original line, being Charles Maraman's corner, thence with the original line N 54° W 214 poles to a stone, corner to 100 acres conveyed by Adam Shepherd to Benjamin Stansberry, thence with Stansberry's line N 36° E 30 poles to a stone in said line, thence S 54° E 214 poles to a stone in Charles Maraman's line, thence with said line S 36° W 30 poles to the beginning.

Also one other tract or parcel of land containing 127 acres more or less, part of James Brend's survey of 977 acres situate lying and being in said county on the south side of Salt River and bounded as follows, to wit.

Beginning at a stone where a beech and elm stood, being the second corner of Shepherd's 600 acre survey, thence N 54° W 360 poles to three maples on the bank of Salt River at low water mark, thence down said river with its meanders 81 poles to an elm on the bank of said river, Jacob Bowman's corner as decreed by the Nelson Circuit Court in the case of said Bowman against Thomas C. Brashear and others, thence with the decreed line S 54° E 350 poles to Bowman's line as originally surveyed, thence with said line 81 poles to the beginning.

To have, and to hold the said tracts or parcels of land and appurtenances unto him, the said, Francis Maraman, his heirs, executors, administrators, and assigns, and to his, and their only proper use, benefit and behoof forever. And the said Henry C. Jones and Ellender his wife covenant with the said Francis Maraman, that they will and their heirs shall, warrant and forever defend the said two tracts or parcels of land and appurtenances unto the said Francis Maraman, his heirs, and assigns from themselves, their heirs, and from all persons claiming the same by, from, through or under them, a reference to a deed filed in the clerk's office of the Bullitt County Court from William Pope to the said Henry C. Jones is made to show title. In testimony whereof the said Henry C. Jones and Ellender his wife hereto set their hands and seals the day and year before written. (signed) Henry C. State of Kentucky, Bullit County Sct. 20 December 1834 I Noah C Summers, clerk of the said County Court, do certify that this deed from Henry C. Jones and Ellender his wife to Francis Maraman, was this day produced to me, the clerk of said County Court, and acknowledged by the said Henry C. Jones, and Ellender, his wife, to be their act and deed. And she, the said Ellender, being by me privily examined separately and apart from her said husband, declared that she did freely and willingly seal and deliver said deed, and again acknowledged the said deed, shown and explained to her by me, to be her act and deed, and consented that the said deed might be recorded and did not wish to retract said acknowledgement. And thereupon said deed and this certificate are truly entered of record in my office. Att. Noah C. Summers, C.B.C.C.
