James H. Anderson's 1865 Last Will and Testament

On 4 Apr 1865, James H. Anderson made his last will and testament. It was recorded in Bullitt County on 3 Mar 1866. He was a son of John Anderson who had died in 1856, and brother-in-law to William Shain.

In the name of God, amen. I James H. Anderson of Bullitt County, Kentucky do make and publish and declare this my last will and testament.

First, I desire all my just debts to be paid. Second, whatever of my estate, real and personal, remains after the payment of my debts I will and devise to my niece and nephew Susan Bell Shain and Philip Lee Shain, the orphan children of my sister Ann E. Shain, to them and their heirs forever.

But if either of them die, leaving no heirs of their body then the whole is to go to the survivors. And if they should both die, leaving, no child or children then the whole to go to my sister Susan Anderson, if she survived them. And in case she is not then living, the whole of my estate to go to my brother John P. Anderson and his heirs.

In testimony, whereof I have hereto set my name this 4th day of April 1865.

State of Kentucky, Bullitt County, Sct. I R. J. Meyler, clerk of the Bullitt County Court, certify that on the 3rd day of March 1866 the foregoing last will and testament of James H. Anderson dec'd was produced in open court and proven by the oaths of H. Clay Crist and John C. Hornbeck, subscribing witnesses thereto to be the last will and testament of said testator, and that he was of sound mind and disposing memory, signed said will in their presence, and that they signed and witnessed said will at the request of said testator, and in his and each other's presence, and being fully proven was ordered to be recorded, which with this certificate is truly done this 15th day of June 1866, the same being duly ...
