Samuel Hornbeck to John Anderson- Shepherdsville Lots 60-61 & Part of 59

On 19 Mar 1838, Rufus K. Summers sold lots 60 and 61 to Preston N. Hornbeck, and also 25 feet of lot 59. The deed was complicated as he held Frederic G. Alexander's bond for the 25 feet of lot 59, and Benjamin Summers' bond for two-thirds of lot 60 which he was transferring to Hornbeck.

Later, Hornbeck mortgaged the lots to John Anderson, and following Hornbeck's death, the Circuit Court ordered the sale of the lots to pay the mortgage, and Anderson purchased the lots at this sale from Samuel Hornbeck, only heir of Preston, as shown below.

Anderson sold the lots to Alban S. Purdy on 6 Jun 1850.

This indenture made this 27th of July 1848 between Samuel Hornbeck, only and infant heir of Preston N. Hornbeck dec'd by Noah C. Summers, commissioner appointed for him for that purpose by the Bullitt Circuit Court of the one part, and John Anderson of the second part.

Witnesseth that whereas in the suit in chancery in the Bullitt Circuit Court in the name of John Anderson against said Samuel Hornbeck, only heir of P. N. Hornbeck dec'd, John L. Thixton and the said court did by its decree in said cause of the 8th April 1847 decree and order that the interest and title of said Samuel Hornbeck, heir of said P. N. Hornbeck dec'd in lots No. 60 and the parts of lots adjoining said lots on Water Street in Shepherdsville, Bullitt County, Kentuckhy, being part of lots No. 59 and Lot No. 61 as owned by said P. N. Hornbeck and mortgaged by him to John Anderson as per mortgage and papers in said chancery cause shows, should be sold to satisfy said Anderson's decree as therein named, and appointed H. C. Thomas a commissioner to sell the same , and said commissioner did in pursuance to said decree and orders in said cause sell at the courthouse door in Shepherdsville on the 15 Nov 1847 and John Anderson purchased said lots and part of lot as aforesaid for the sum of $550 in part satisfaction of his said decree, and said commissioner return said sale and report to the said court at the April term thereof 1848, and said sale and report was confirmed by the court by its order is said cause. And said N. C. Summers was appointed commissioner to convey, reference to the whole suit and decrees, orders and proceedings had therein will show.

Now, in consideration of the whole premises herein named, he the said Samuel Hornbeck, only heir of said Preston N. Hornbeck dec'd by said N. C. Summers, commissioner for him for that purpose, has sold and conveyed, and by these presents does sell, convey and confirm unto him the said John Anderson, and to his heirs and assigns forever, the said lot number 60, part of lot number 59 and lot number 61 on the new plan of said town of Shepherdsville as owned by said P. N. Hornbeck dec'd.

To have and to hold the said lots and parts of lots aforesaid unto him the said John Anderson and to his heirs and assigns forever against the claims of him the said Samuel Hornbeck, only heir of said P. N. Hornbeck dec'd, and against the claims of all other persons as fully as by law and the terms of said decree and orders he said commissioner can warrant and defend title to said Anderson to lots and parts of lots aforesaid without liability of said commissioner.
