Nathan Evans to Theodocia Purcell - 107.5 Acres

On 1 Jun 1834, John Purcell signed his will, essentially leaving his estate to Nathan Evans with the stipulation that Evans provide for Purcell's wife Doshy (Theodocia) during her lifetime. This arrangement continued until 26 Feb 1850, when they agreed that Theodocia was to have part of the land along with the house, fulfilling Nathan's obligation to her. The deed is shown below.

Despite this deed, it appears that the entire 400 acres was still in Evans' hands when he died sometime before March 1851, for half of it, 200 acres, was sold by the Circuit Court to William Patterson to satisfy Evans' obligation to Theodocia Purcell, and then the other half was sold to a Louisville firm, Smith & Rowland to satisfy his debt to them [Deed Book N, page 286].

This indenture made and entered into this 26th day of February 1850 between Nathan Evans of the County of Bullitt and State of Kentucky of the one part, and Theodocia Purcell of the County and State aforesaid of the other part.

Witnesseth, whereas John Purcell by his last will and testament of record in the Bullitt County Court devised to Nathan Evans all of his property, real and personal, including a tract of land containing 400 acres and four Negroes, with the proviso that he the said Nathan should pay to the said Theodocia Purcell, the wife of said John Purcell, an annuity of $75 per year.

Now therefore by mutual agreement the said Theodocia Purcell has by deed of release conveyed to the said Nathan Evans all of her right of in and to the land and slaves of the said John Purcell which deed of release is dated the 6th day of February 1850, for and in consideration of which the said Nathan Evans conveying to him [her] 107 1/2 acres, 26 poles acres of the tract of land deeded to the said John Purcell by Thomas Purcell on the 5th day of July 1805 and of record in the County Court Clerk's office of Bullitt, reference is had to said deed, the said 107 1/2 acres and 26 poles includes the dwelling house of the late John Purcell and the eastern part of said tract of land above referred to.

Now therefore the said Nathan Evans for and in consideration of said deed of release above referred to hath granted, bargained and sold and by these presents doth grant, bargain and sell unto the said Thoedosia Purcell 107 3/4 acres 26 poles of the 400 acre tract above named, and which is bounded as follows, viz.

Beginning at a stone, the northeast corner of said survey, thence S 10° E 19 5/25 poles to a stone, corner to H. Hart's land, thence S 13° E 263 poles to a stone, the southeast corner of said 400 acre tract, thence S 78° W (for S 80° W) 65 poles to a stone in the original line of said 400 acres, thence N 13° W 263 poles to a stone in the northern line of said 400 acres, thence with the original line N 78° E (for N 80°) 66 poles to the place of beginning, containing 107 1/2 acres and 26 poles aforesaid, be the same more or less, together with all and singular the appurtenances thereunto belonging or in any wise appertaining, but reserves the right of a road or way to be one pole wide from his part of the 400 acre tract to the Shepherdsville Road, to bind on the northern side of the knobs next to the Pine Tavern, or on northern side of the knobs next to the southern side of the farm as now occupied by me.

And the said Nathan covenants and agrees to and with the said Theodocia Purcell that he will and his heirs shall forever warrant and defend the premises as above described with the above exceptions against the claim of all and every person claiming or to claim the same in any manner whatever.
