Crist Estate to Robert F. Samuels - 2 Long Lick Tracts

Following a Circuit Court Suit involving Henry Crist's estate, two tracts of land along Long Lick Creek were sold at auction to Robert F. Samuels as shown below.

Whereas there issued from the clerk's office of the Bullitt Circuit Court an execution fieri facias No. 347 in favor of William Scanland against the estate of Henry Crist dated the 12th day of July 1841, returnable on the 11th day of September 1841, directed to the sheriff of Bullitt County for the sum of $384, and interest thereon at 6% per annum from the 10th day of December 1822 till paid, and $23.86 1/2 cents cost subject to the following credits. Credit for $150 paid 24th June 1824, $32.50 paid 23 August 1825, $.95 paid 17th November 1827, $29.68 paid 20 October 1828 per endorsements on executions, and for $1.25 paid 5 July 1841.

Which execution came to the hands of Julius C. Buky, Deputy Sheriff for Henry F. Kalfus, Sheriff of Bullitt County on the 13th day of July 1841 at 10 o'clock A.M., and was levied by Julius C. Buky, Deputy Sheriff as aforesaid on the 11th day of September 1841 on all the right, title and interest of Henry Crist in and to 400 acres of land in Bullitt County patented to William Fitzhugh and William Cave, being the balance unsold of said survey on the bounds of the survey of Cave.

Also on all the right in equity and equity of redemption of said Henry Crist in and to 2000 acres of land patented to William Fitzhugh and part of the survey of William Cave, which two surveys interfere; and advertised to be sold at the courthouse door in Shepherdsville on the 18th day of October 1841.

And plaintiff and defendant having failed to select commissioners to value said land, the said Julius C. Buky, Deputy Sheriff as aforesaid, valued the 400 acres unsold of Cave at fifty cents per acre.

And the said Julius C. Buky, Deputy Sheriff as aforesaid, after having advertised and proceeded in all things as by law required, on the 18th day of October 1841, at the courthouse door in Shepherdsville, sold all the right and title of said defendant Henry Crist in said execution to the said 400 acres of land, and Robert F. Samuels became the purchaser at and for the sum of five dollars, he being the highest and best bidder.

And on the same day and at the same place at the courthouse door in Shepherdsville aforesaid, the said Julius C. Buky, Deputy Sheriff as aforesaid, sold all the right and equity of redemption of defendant Henry Crist in said execution of, in and to the 2000 acres of land heretofore sold of the same survey of William Cave and William Fitzhugh which he heretofore sold under an execution No. 308, issued from the office of the Bullitt Circuit Court in the name of William Newboult against Henry Crist and others; and Robert F. Samuels became the purchaser of said equity or redemption of defendant Henry Crist in said execution to said 2000 acres so sold at and for the sum of $20.

Reference to said execution of Scanland against Crist, and Sheriff's return thereon, and the levy giving up in writing by Crist under said execution in the name of Newboult dated 5 March 1841, and No. 152 and 308 from the office of the Bullitt Circuit Court and Sheriff's sale of the 2000 acres under the execution in the name of Newboult was on teh 21st day of June 1841 will more fully show; and a reference to the deed of Samuels, commissioner for Cave, to said Henry Crist recorded in Bullitt Circuit Court Deed Book A, page 316, and dated the 4th day of October 1838 will show the boundary and location of said Cave tract, so sold under said executions as aforesaid.

The land so sold as aforesaid lays on Long Lick Creek in Bullitt County, and joins Gerald Briscoe, John Overall, Ebenezer Platt, Henry Banks and others, and the 2000 acres first sold under the execution of Newboult lays on the eastern end, and the balance 400 acres more or less as aforesaid here conveyed lays on the western or lower end of the tract, and the 2000 acres the equity of redemption of which is here conveyed lays on the upper or eastern of said survey as aforesaid of the Cave tract, which part said 2000 acres of said Cave was supposed to interfere with the Fitzhugh tract named in Crist's memorandum for the levy.

Now for and in consideration of the premises and the power vested by law, the said Henry F. Kalfus, late Sheriff of Bullitt County, doth hereby sell and convey to the said Robert F. Samuels, his heirs and assigns, all the right and title and interest of the said Henry Crist of, in and to the 400 acres of land, more or less, being the balance of Cave's 2415 acre survey, after laying off the 2000 acres sold as aforesaid under the execution of Newboult; also the equity and right of redemption of said Henry Crist of, in and to the 2000 acres sold as aforesaid and purchased by said Samuels as aforesaid under the execution in the name of Scanland against Crist.

To have and to hold the said 400 acres more or less, and also the equity of redemption of the 2000 acres unto the said Robert F. Samuels, his heirs and assigns, against the claim of the said Henry Crist and all others as fully as the said Kalfus as sheriff under and by virtue of the levies and sales aforesaid, is authorized to convey without incurring any individual responsibility as sheriff. Witness the hand and seal of the said Henry F. Kalfus, as sheriff, this 5th day of May 1848.
