Crist to Kinnison - Part of Bullitt's Lick Tract

On 24 Dec 1831, Austin Hall, as a former deputy sheriff, completed the transfer of three-tenths of the Bullitt's Lick 1000 acre tract to Alonzo C. Kinnison, heir of John R. Kinnison, as shown below.

Whereas there issued from the Clerk's office of the Bullitt Circuit the following Fiere Facias Execution No. 777, to wit; "The Commonwealth of Kentucky to the Sheriff of Bullitt County, Greeting. You are hereby commanded that of the estate of Henry Crist, John R. Kinnison and Lewis Willcoxon Jr., late of your bailiwick, you cause to be made $400 which John Dunn late in our Bullitt Circuit Court recovered against them for debt by virtue of a Replevin Bond filed in my office, and also 98 cents and $5.45 costs of sheriff's commission on stay by judgment which was adjudged to the said Dunn for his costs on that behalf expended; whereof the said H. Crist, J. R. Kinnison &c are convict as appears to us of record, and that you have the same before the judge of our Bullitt Circuit Court at the courthouse in Shepherdsville on the 12th day of August next to satisfy and pay the said debt and costs aforesaid; and have then there this writ. Witness Noah C. Summers, clerk of our said court at the courthouse aforesaid this 27th day of February 1828, and in the 36th year of the Commonwealth. N. C. Summers."

That this execution may be discharged by the payment $192.85 with interest thereon at the rate of 6% per annum from the 4th day of October 1825 until paid and the costs within mentioned. No security of any kind is to be taken. Att: N. C. Summers, clerk.

Which execution was placed in the hands of Austin Hall, Deputy Sheriff for Clifton Hall, Sheriff of Bullitt County to levy and execute as will appear by the following endorsement on said execution, to wit. "Came to hand the 27th of February 1828. Austin Hall, Deputy Sheriff for Clifton Hall, S.B.C."

By virtue of which execution the said Austin Hall, Deputy Sheriff as aforesaid, did levy on Henry Crist's interest in and to a tract of land known by the name of the Bullitt's Lick tract, said interest being three-tenths of said tract, and after having advertised according to law, did on the 6th day of May 1828 publicly in market overt sell the said interest of said Henry Crist in said tract of land, and John R. Kinnison became the purchaser of said interest for the sum of two cents, he being the highest bidder, all which will more fully appear by the following return on said execution, to wit.

By virtue of this execution I levied on Henry Crist's interest in and to a tract of land known by Bullitt's Lick tract, it being three-tenths of said tract, and sold the same on the premises on the 6th day of May 1828, and John R. Kinnison became the purchaser for two cents, he being the highest bidder, which I have ready to pay H. Crist's interest valued by commissioners to $1800. Austin Hall, D.S. for Clifton Hall, S.B.C.

And whereas also since the sale and purchase aforesaid, before any deed could be made for the interest so sold and purchased, the said John R. Kinnison departed this life intestate, leaving Alonzo C. Kinnison his only heir and representative. Now this indenture made this 24th day of December 1831 between the said Austin Hall, late deputy sheriff for Clifton Hall, Sheriff of Bullitt County and Henry Crist and Rachel his wife (who join in this conveyance for the purpose of confirming the sale made as aforesaid) of the one part and the said Alonzo C. Kinnison of the other part.

Witnesseth that the said Austin Hall, deputy sheriff as aforesaid, for and in consideration of the levy sale and purchase aforesaid and the power vested in him by law, and the said Henry Crist and Rachel his wife for the further consideration of one dollar to them in hand padi before he sealing and delivery hereof, the receipt whereof is hereby acknowledged, have granted, bargained and sold and by these presents do grant, bargain and sell alien, release, convey and confirm unto the said Alonzo C. Kinnison, his heirs, executors, administrators and assigns all he right, title, interest and claim of him the said Henry Crist of in and to the said tract of land, being three-tenths described in the return of the said deputy sheriff.

To have and to hold all the right, title, interest, and claim of the said Henry Crist of in and to the said tract of land, and appurtenances described as aforesaid to him, the said Alonzo C. Kinnison, his heirs, executors, administrators and assigns, and to his and their only proper use, benefit and behoof forever.

And the said Austin Hall, late deputy sheriff as aforesaid, covenants to and with the said Alonzo C. Kinnison to warrant and defend the interest hereby conveyed as far as by law he is bound to warrant and defend, and no further. And the said Henry Crist and Rachel his wife also covenant and agree to and with the said Alonzo C. Kinnison that they will and their heirs shall warrant and forever defend the interest sold and described as aforesaid and hereby conveyed to the said Alonzo C. Kinnison, his heirs, executors, administrators and assigns from themselves and their heirs and from the claim or claims of all and every person or persons lawfully claiming or to claim the same. In testimony whereof the said Austin Hall, late deputy sheriff for Clifton Hall, Sheriff of Bullitt County, and Henry Crist and Rachel his wife set their hands and seals on the day and year within written.
