Henry Barth to William Lacey - 57 Acres

This deed, written on 29 Dec 1851, transferred 57 acres of land on the north side of Salt River near Shepherdsville from Henry Barth to William Lacey of Louisville. It had also to do with the ferry located nearby.

This indenture made this 29th day of December 1851 between Henry Barth and Elizabeth Barth his wife of the county of Bullitt and state of Kentucky of the one part and William H. Lacey of the city of Louisville of the other part. Witnesseth that the said Barth and wife for and in consideration of eight hundred dollars to be paid in fouir equal annual payments of $200 each with interest on said sums from date until paid for which the said Lacy has executed his notes of even date herewith, they the said Barth and wife have sold and conveyed and by these presents do sell and convey unto him the said William H. Lacey and to his heirs and assigns the following tract of land in Bullitt County, Ky., on Salt River just above and adjoining the town of Shepherdsville containing about 57 acres and bounded as follows.

Beginning at a large beech tree stump on the bank of Salt River, the S.E. corner of said town, thence with East Street N 7° E [for 6 1/2°] 20 poles to a stake being two poles S 7° W from the S.W. corner of the seminary lot, thence S 83° E __ poles to a stake being two poles S 7° W from the seminary lot and corner agreed on by the parties, thence with the division line through the seminary lot agreed on between the trustees and H. O. Maraman on the southeast side of the drain through the seminary lot, this division line continued the course as agreed as aforesaid to the agreed corner of Maraman and the seminary lot opposite Third Steet of said town, thence N 83° W to East Street to corner agreed on by H. O. Maraman and Seminary [see orders on records of seminary books for said agreement and courses] thence with East Street and courses of same N 7° E [for 6 1/2°] __ poles to a stake in the original line of Shepherd and McGee, thence with said line S 37° E 167 poles to where the fence between Colemesiel and Barth strikes Salt River which is supposed to be the original corner of two beeches and a sugartree on the bank of Salt River, thence down said River meandering the same S 65° W 70 1/2 poles, N 84° W 21 poles, N 42° W 46 4/10 poles to the beginning.

Out of this boundary said Henry Barth retains title to one half acre of ground at the ferry landing and said Barth retains out of this boundary the reservation in the deed from H. O. Maraman to Henry Barth dated 12 November 1847, being the half acre aforesaid, and the road leading through said land to the ferry aforesaid, and said Barth for the consideration aforesaie conveys the half acre lot in Shepherdsville No. 80 in the new plan of said town on his title thereto, but without warranty of title for this lot No. 80 except against himself and those claiming by, through, or under him with the appurtenances to said lands belonging (with the exceptions aforesaid) to him the said William H. Lacey to warrant and defend the said land and appurtenances here sold (with the exceptions) unto him the said Lacey, his heirs and assigns, forever against the claim of all persons whatever it is hereby understood out of this conveyance and warranty is reserved the half acre at the ferry landing aforesaid, the right of the ferry road as now established or the right to use any other ferry way for a road to a ferry that the county court may establish to said ferry, and the title only by quit claim aforesaid is made to said lot No. 80 and by consent of the parties a lein as allowed by said Lacey and retained by Barth on the land for the purchase money aforesaid. State of Kentucky, Bullitt County Sct. I Robert F. Samuels, clerk of the county court aforesaid, do certify that on the 29th day of December 1851 this deed from Henry Barth and Elizabeth his wife to William H. Lacey was produced to me in my office and acknowledged by the said Barth to be his act and deed, and the said Elizabeth, being examined by me privily and apart from her said husband, declared that she did freely and willingly sign, seal and deliver said writing and wished not to retract it and acknowledge said writing again shown and explained to her to be her act and deed, and consented that the same might be recorded which is truly done in my said office this 17th July 1852.
