Ann E. Shane's 1864 Last Will and Testament

Ann Anderson Shane, widow of William Shane, made her own will on 21 Sep 1864. It was proven in court on 3 Nov 1864.

I Ann E. Shane being of sound mind make this my last will and testament. I will to my children Susan J. Shane and Philip L. Shane all my estate, real, personal and mixed, and I appoint Dr. S. A. McKay executor of this my last will and testament. And it is my will that he shall sell only so much of my personal property as is necessary to pay my debts, and he is authorized to sell so much as is necessary for the above purpose at private sale. The balance of my personal property I do not wish sold, but I wish it and all my other property to remain in the possession of my brother James and sister Susan for the purpose of raising, educating and providing for my children, and my executor is authorized to make a contract with them for that purpose, and to retain power to cancel it, if not properly complied with in his opinion, and in that event he is to sell all my personal estate then unsold. It is my wise that Dr. S. A. McKay act as guardian of my said children and be appointed as such, and that my children remain with my sister Susan and brother James where they now reside and their guardian is requested so to do unless he for reasons satisfactory to himself may think otherwise.

I R. J. Meyler, clerk of the Bullitt County Court certify that on the 3rd day of November 1864 the foregoing will of Ann E. Shane dec'd was produced in open court and proven by the oaths of William R. Thompson and Mary A. Anderson, subscribing witnesses thereto to be the last will of said testator, and being fully proven as by law required and duly, was ordered to be recorded, which with this certificate is truly done in my office this 15th day of June 1866.
