John Anderson's Executor to Anderson Heirs - 300 Acres

Thomas Riley, as executor of the estate of John Anderson, was responsible for dividing the estate's value amongst Anderson's five children. Three of them, James H. Anderson, Susan J. Anderson and Ann E. Shane elected jointly to accept a 300 acre part of the land owned by Anderson as their portion of the estate as described below.

This deed of conveyance made and executed this 10th day of December 1863 by Thomas W. Riley, executor of John Anderson of the first, and James H. Anderson, Susan J. Anderson and Ann E. Shane, children and heirs and devisees of the said John Anderson of the second part, all of Bullitt County, State of Kentucky.

Witnesseth that the said John Anderson, by his last will and testament directed his said executor to sell and convey all his real and personal estate, and after paying all his just debts, to divided the residue of his estate equally among all his children; and the said James H. Anderson, Susan J. Anderson and Ann E. Shane agreed the party of the first part to take as much of the estate of their father devised to them, 300 acres of the homestead tract on which the said John Anderson lived and died, including the mansion house and outhouses and improvements, as surveyed and laid off to them by John Robb, surveyor of Jefferson County, at the price of $9000 to be charged to them as so much received by them of the estate of their father; and the said executor being now satisfied that the estate will divide more than $3000 to each heir and devisee, and that the said sum of $9000 is a fair price for said 300 acres of land, agreed and does hereby sell and convey the same to the party of the second part according to said survey of John Robb, by the following metes and bounds, to wit.

Beginning at a stone in the Louisville and Shepherdsville Road, corner to Armstrong's heirs, thence North 98 poles to a stone in said road, corner to Rogers' and Harrison's lands, thence West 96 1/2 poles, thence North 1° West 37 poles to a stone, thence South 80 3/4° West 164 poles to a dead forked white oak (now down), thence South 8° East 149 poles to a stake in a hollow (white oak and red oak marked as pointers), thence North 80 3/4° East 343 poles to the beginning; with all and singular the appurtenances belonging to the said tract of land to them the said party of the second part and their heirs and assigns forever.

And the party of the first part as executor as aforesaid does hereby covenant and agree to and with the party of the second part that the title to the forenamed and described tract of 300 acres of land, be the same more or less, he will as executor as aforesaid, to the extent of any portion of said estate remaining in his hands if a breach of this warranty should ever occur, forever warrant and defend the title to the said party of the second part and their heirs and assigns forever against the claims of all persons claiming the same.
